I married on VWP and intended on submitting an AOS here in the States, but have recently realized submitting in San Diego is a bad idea, especially now I am out of status, so I am returning home and going CR1. Best of luck :)

Ready for my grand ol' timeline? Alrighty then!

10-05-10 - Married in California
06-13-11 - I-130 approved
10-13-11 - CASE COMPLETE!
12-02-11 - Interview - 221g due to a washed passport
12-17-11 - POE - YYC (preclearance in Canada)

2011 to 2013 - Life happened

06-26-13 - Divorce finalized

10-07-13 - I-751 divorce filer paperwork journey begins

07-03-14 - ROC interview - approval pending delayed background checks

07-25-14 - APPROVED! 10 year GC is finally in production!

08-01-14 - 10 year GC in hand. The journey has finally ended. :)

2014 to 2020 - Living paperwork-free and focused on me!

11-09-20 - N-400 filed online - welcome back VJ fam!

6-22-21 - Interview in Nashville, approved! And then...

6-22-21 - Pledge of Allegiance taken. Holy shirtballs I'm a US Citizen.

Just my thoughts, but I feel like deporting overstayers at this point is a bit unfair. It seems like the majority of overstayers (on here at least) were just under the assumption that it would be forgiven, as was the usual course of action until a couple of months ago. To slap a 10 year ban on them through deportation is a little harsh, I say give them chance to leave in 30 days or something, no repercussions, and change the law for anyone overstaying from now on instead.

I dont think this is new policy. I think this is just policy that we just realised was being enacted. Some of these cases go back to 2003 so it was always in the water (So to speak). I came on the VWP and I regret it a lot. Then again I have been here for 13 years so I figure what do I have to lose? I am already out of status.Well actually when you think about it VWP are the same as EWI.

I remember looking at the green I-94 back in 1998 and knowing that there was no appeal. I hadnt intended to overstay so it was curious to me. It means a lot more now.

If you are able to file from outside the US then do it. It just seems easier considering the pitfalls of being denied in San Diego.

Unbelievable that my journey took this long but Im thankful

Hi guys, I haven't been on this site for a long time...our AOS interview was scheduled for January but then a snow storm caused it to be moved to March 17. We just came home, and I am happy to announce that we are APPROVED!

We had started and stopped the K-1 process (our lawyer screwed it up, making it take 2 years, long story!) and got married on a VWP, but we are being given a green card anyway. In the end, just tell the truth as complex as it may be, and all will be fine. I was super stressed out and nervous -- I even cried a bit when he stamped our forms -- but now I can breathe a sigh of relief because my husband and I will not be separated.

A big thanks to the kind folks at the USCUS office in Raleigh, NC for being fair and trusting the truth -- that we just want to spend our lives together with the ones we love!

If anyone has specific questions about the interview and going through AOS on VWP, please message me.

June 1997 - Met at summer camp; became friends over the next two years but lost touch

August 2007 - Ron finds Jody on Facebook and relationship begins

September 2007 - Ron visits Jody in US

October 2007 - Ron visits Jody in US on and off for 9 months

July 17, 2008 - Ron returns to Germany

August 20, 2009 - Jody visited Ron in Germany for 10 days after 13 months apart!

May 15, 2010 - Ron visited Jody on VWP

Legally married - May 20, 2010 (after 13 years, couldn't stand being apart anymore!)

That crying is called relief.

WOW - Congrats. You guys were processed and approved at an incredible speed. I filed roughly at the same time, did biometrics at around the same time, and haven't heard a thing since...

It's good to read that you got approved without much hassle - a beacon of hope for the rest of us!

What they assumed or did not assume has no bearing to USCIS. Try to tell ICE that you assumed you would be able to stay and see how understanding they are. Just because there were 10 other people speeding down the highway just the same as you is not going to fly as an excuse when you were the one stuck with the ticket.

What they assumed or did not assume has no bearing to USCIS. Try to tell ICE that you assumed you would be able to stay and see how understanding they are. Just because there were 10 other people speeding down the highway just the same as you is not going to fly as an excuse when you were the one stuck with the ticket.

Well happily the word is they are processing VWP overstays so alls well that ends well,
