I'm living in the US under a L1A visa for the past two and a bit years. I've been married to a USC for 5 1/2 years and we decided to file for a AOS for me to get my GC (so I could potentially pursue a job opportunity that presented itself via a headhunter).

I filed earlier this month (got NOAs and bio letter, now awaiting my biometrics appointment - may do a walk in soon).

When I filed I did ask for an AP since I thought I may as well apply for everything in one go, especially if I changed jobs (once I got the EAD).

Now I need to travel for business with my existing employer. The USCIS website suggests its fine to travel under a L1 visa without AP.

My questions are :

1. Does it matter that I applied for AP?

2. Is there anything I need to do before leaving the country to notify the USCIS?

3. When I re-enter the country do I mention anything about the AOS to the immigration agent, or just fill in the forms per my L1 as I have always done.

08/12/2010 => Day 00 => Package sent to Chicago lockbox

08/13/2010 => Day 01 => Package received and signed for in Chicago

08/23/2010 => Day 11 => Email and Text receipt notification

08/23/2010 => Day 11 => Cheques cashed - $1010 and $355

08/26/2010 => Day 14 => NOAs received in the mail

08/30/2010 => Day 18 => Received biometrics appointment letter (for 9/23)

09/03/2010 => Day 22 => Did walk-in biometrics

09/16/2010 => Day 35 => Received interview letter for 10/21

10/15/2010 => Day 64 => AP received

10/20/2010 => Day 69 => EAC received

10/21/2010 => Day 70 => AOS Interview, approved, I-551 stamp and card production ordered

10/30/2010 => Day 79 => Green card received

No.

Nothing.

3. When I re-enter the country do I mention anything about the AOS to the immigration agent, or just fill in the forms per my L1 as I have always done.

You will enter with the valid L-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for the tips. I thought that was the case, but you never know!

Just did my biometrics on Friday - so moving forward with the case.

08/12/2010 => Day 00 => Package sent to Chicago lockbox
