Can anyone help me before I start a panic attack :help: my lawyer just sent me an email saying that it is my responsibility to maintain/extend your valid temporary status. She stated that I needed to contact the USCIS to renew my temporary stay here. What is she talking about? can anyone enlighten me.

You need to file for AOS if you came here on a k1 visa. You have 90 days to marry since the day you arrived to the USA which is stamped in your passport. After you marry you need to file for AOS(check the guides at the top of this website)it is recommended to file as soon as you can once you marry.

that is what I am doing so what is my lawyer talking about? she is supposed to be filing for this and I thought that was the next step in the process. After the wedding of course which was August 14. I have the AP and the EAD documents ready to send with it and it should be filed way before october 8 (expire of i-94)I would hope. So is that not right (panic is setting in - actually getting peeved off this lawyer is horrible)

So after she files this does this not mean that it is in the process or do I require some other form of proof?

please pleaase let me know

Did you actually pay the lawyer to file the AOS? Along with the EAD and AP you have to send the I-485 which is the application to adjust status. It's recommended to file the AOS within the 90 day period however if it's over the 90 days there is no penalty. Just relax.

you have the rest of the AOS documents as well right? not just the AP and EAD forms.

If so and you have it all ready with the supporting documents you really dont need a lawyer to do it for you, you can put the package together and send it yourself. I have no idea what your lawyer is talking about neededing to rewnew temporary status... I have a feeling this lawyer would be a good one to drop.

All you need to do is send off your full AOS package with its supporting documents and the payment and then just wait for the notice of action to come in the mail, then wait for the biometrics notice and go have your fingerprints taken. Then wait for an interview or for an approve AOS and your green card in the mail.

I knew all of that (from being on this web site) We had already paid for the AOS (stupid stupid stupid) but I am putting together the AP and the EAD (she wanted $750 to do that)

the only hiccups I am having right now is my son is here on a k2 of course but on the AP document they want his A # and I am not sure what to put for that because he does not have one listed on the I-94 like I did. Plus do I put the date of our marriage on his AP documnet as well? The only other thing I have is I am waiting on the IRS to send my the transcripts ( it is has been over a month and still nothing) I am going to resend today. But if that is the only thing holding things up can I not send in the 09 transcript since I have the previous years. AT least it will be filed before the deadline, I am thinking?

for the transcripts usually take about 10 days by snail mail, you can also have them faxed to you within 24 hours.

Did your lawyer already mail in the AOS packet ahead of you preparing the EAD and AP documents to send with the AOS? Hopefully not, because USCIS likes them together for processing. Don't worry about the "deadline" of your I-94 expiring. You came to the U.S. on the K-1 visa, as long as you got married (which you said you did on Aug. 14), you satisfied the requirements of the K-1 visa. It is best to file AOS as soon as possible, but some people have waited 2 years or more on this site because they didn't have the $1010 to do the AOS right away. DON'T LEAVE the U.S. with out your Advanced Parole documents, otherwise that would foul things up, but as long as you stay, you have no reason to panic about contacting the government about extending your "temporary status".

Suzique, i've just been reading posts on this site and i think i've seen 3 different posts of this lawyer giving you the wrong info. you should see if you can at least get a partial of your money back, because this lawyer is going to end up giving you a big headache.Make sure he/she knows the specific address to send the application. You should send all the applications together If you dont i think there's a fee for I765(not sure about I131 cuz i didnt apply for that)or if i remember correctly you have to wait to get the I797 for I485 and then be able to send it. anyways Good luck with everyhting. I was going to hire a lawyer too but after just asking questions on this site and reading i decided not to and did it on my own.

Your son's A# is the same as the one printed on your K1 NOA2.

believe me if I could I would, it states right in all her fine print that i can not get my money back. The sad part of all of this is it is not the lawyer it is her assistant. And yes I have tried on many occasions to let her know. I have emailed, and called and I do not get a response back. I figure this is the last step - just keep checking everything over and hopefully it will go smoothly.

Yup, my daughter and I share the same A#, and it is the number printed on your K1 NOA2. It's not printed on your son's NOA2, just yours. :)
