I am trying to figure whats the best way and how to get these Sworn Affidavits done in the Philippines. Is their a special form or its just a writtien statement that their present in the wedding and if needs to be notrized.

An affidavit is a formal sworn statement of fact, signed by the author and witnessed by a taker of oaths, such as a notary public, so to answer your question, yes, affidavits need to be notarized.

Thanks for the info. But what I am looking for is type affidavit to add to my I-130 requirements for support of my marraige so I have it done ASAP

Thanks for the link. I don't if I was clear but what I was looking for an affidavits that I would need to have to add to my support of my marraige for my I-130. I looked the link I don't know if that's something that would be ok.

Re: Affidavit affirming knowledge of marital relationship.

This is what it says on the I-130 instructions:

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage)

So.....as long as it has the above information, it can be hand written, typed, or created with a word processor.

It may appear more personal if it is hand written! If it is handwritten ..... it MUST be readable!!!

The more important things to be aware of are the instructions after the words "must contain"......

If each affidavit does not contain ALL of this information...it will be a waste of time!!

Using the format in this link http://www.sample-le...same_person.htm change the body of the affidavit to the one below and feel free to add some more narrative. The lawyer will charge less (just the notarial fee) if he doesn't have to compose the affidavit.

I, (Insert name of affiant) , Filipino citizen, of legal age,single/married to (insert name of spouse if any), and a resident of (insert address of affiant), after having been duly sworn in accordance with law,hereby depose and say:

1. That I am the best friend of (insert name of your wife) wife of (insert your name), an American citizen;

2. That I know for a fact that they are happily married because I stood as a sponsor (or bridesmaidor maid of honor) (or I was one of the guests) at their wedding which took place on (insert date) at (insert place);

3. That ........................ (insert other proof of bonafides of marriage like children, regular sending of money, etc. etc. )

4. That I am executing this affidavit to attest to the truth of the foregoing and forwhatever legal purpose it may serve.

Further affiant sayeth none.

My wife got them by going to a lawyer at the local Municipal Hall. I'm not sure that this is standard throughout the Philippines though, but they seemed to know exactly what to do. She had to pay a fee, but the results looked very professional to me. Plus, they registered the affidavits at the municipality...so, at least they is a legal paper trail if the US wants to pursue it.

Plus, they registered the affidavits at the municipality...so, at least they is a legal paper trail if the US wants to pursue it.

+1 We also used a lawyer to create the affidavits.

I'm sorry, my wife didn't mention the actual cost of the fee...but I don't think it was too expensive. You can inquire at your local municipal hall about the cost of sworn affidavits though. If they have a staff lawyer, I'm sure they can help you. This was in a very rural town in Mindanao, so I suspect those services are available most anywhere in the Philippines.

Mhay got 4 affidavits and I think it only cost like 400 or 500 pesos...I didnt think it was much. I think we got 2 copies of each affidavit .

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

So we didn't use an attorney........

We thought it would look more personal...more "real" if each affidavit was in their own words.

Some they had to re-write to make sure everything was put in the text.

We also made copies and got everything notarized.

I think we had 5 affidavits......it doesn't tell anywhere how many or how few to send so it is up to you....how good is the information they put in the affidavit?

I know it is different than what many have done...but it just shows....there are many different ways to prepare everything.

I think everyone would agree....not any one (1) thing that will make the case.....but any one (1) thing could destroy the case.

Prepare as best you can and be sure that all the information is good and helpful!

Same here - 200 I think for two affidavits and copies. We had Merlaines' attorney friend do them for us. He was also a sponsor at our wedding :thumbs:

Fees would depend on the notary public you are using.

No need for a lawyer, really...if you have all the elements needed for a proper sworn affidavit, and the supporting documents (commonly notary publics will require affiants to appear in person and present identification, such as a passport) which is also noted on the affidavit. We also attached photocopies of their passports to the affidavits for notarization.

This is the format I prepared for one of our witnesses, Rick's mom:

Sworn Affidavit Attesting to the Bona Fides of Marriage Between <name of groom>, hereinafter referred to as the GROOM

and

<name of bride> (nee <maiden names and aliases, in case the bride was previously married>), hereinafter referred to as the BRIDE

We, SPOUSES <name of father>, of legal age, American, married, born <date of birth> in <place of birth>, currently residing at <complete address>,

and

<name of mother>, of legal age, American, married, born on <date of birth> in <place of birth>, currently residing at <complete address>, hereinafter referred to as the WITNESSES, do hereby declare as follows:

1. That the GROOM is our biological son born <spouse's date of birth> in <place of birth> and currently resides in <city where spouse lives>.

2. That the initial communication between the BRIDE and WITNESSES was via Text Message in <date we first started communicating>.

3. That throughout the summer of 2008 the BRIDE and the WITNESSES shared via text messages, e-mails and telephone calls matters of interest pertaining to each family so as to enable the Witnesses to become familiar with the BRIDE and her family.

4. That in September <year> while the WITNESSES were at the home of and in the presence of the GROOM in his home in <current residence>, the BRIDE spoke with the WITNESSES via a telephone conversation to announce that the GROOM had presented the BRIDE with an engagement ring during his last visit to the Philippines, and were planning to get married.

5. That one of the WITNESSES, <name of Rick's mother> did fly to Manila, Philippines on <date> to attend and participate in the marriage ceremony between the Bride and the GROOM held on <wedding date> at the <venue>.

6. That the WITNESSES can attest to the ongoing marital relationship between the BRIDE and the GROOM, as they witness the regular, consistent communication between them via text messaging, telephone calls, e-mails and snail mail up to the present day, and the WITNESSES maintain the same relationship with the BRIDE via the same means of communication.

You can personalize this however you want, depending on the circumstances and the relationship of the affiant to you and your significant other.

We prepared similar affidavits for two other couples; one of them was my co-worker and her husband, who made my dress and who was one of the official photographers of our wedding, respectively; and another couple who my husband and I interacted with a lot and served as one of the witnesses at our wedding ceremony.

We had a notary public down the hall from where my old office was in Makati. Can't remember what he charged but for each set of affidavits it was less than Php 200. Rick's mom of course had theirs done in the US, no idea how much that cost them.
