What do you need to travel inside the US after your I-94 expires? We don't have a green card yet...My wife wants to go on a trip but I don't know if we can. What do you need to do to travel inside the US?

All you need is a government issued ID(passport, EAD D/L e.t.c). It doesn't matter if it was issued in the US or your home country, they only need to verify your identity.

You should carry your NOA from the AOS in addition to the passport (and any state id) you may have. (since your I-94 is expired, you would have to prove your current legal status, the NOA will do that for you)

I would also recommend a copy of the marriage certificate, just in case.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If you have submitted the Adjustment of Status petition and received the NOA then carry that along with her passport showing the visa. If you haven't begun the adjustment of status process then it's probably a good idea to avoid Arizona and any other area where there are CBP inland inspection stations.

For air travel a gov't (any gov't) ID in the same name as the ticket is all that is needed.

And, if anyone reading this thread has filed for AOS but not yet received the NOA1, carry a copy of your AOS cover-letter (and, ideally, of the $1,010 payment!) in lieu of the NOA1. Until my wife received her green card, I had her carry her most up-to-date papers with her at all times, even if these were interim items.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

For a spousal visa entrant, this is true. For a K-1 entrant, not so much.

The K-1 entrance passport stamp and I-94 in her passport is enough information to tell any inquisitive civil authority that she entered the country legitimately. Unfortunately K-1 entrants have to leave by the 90th day unless they marry [and ideally begin the process of adjusting their status]. The passport by itself does not contain documentation that a marriage occurred within the 90 day deadline, much less that AOS was begun. That is why it is important for a K-1 entrant to carry the marriage certificate and AOS NOA1 once their I-94 expires if there is any reasonable likelihood of encountering federal immigration or law enforcement - this additional documentation is their only proof that they have not illegally overstayed their K-1.

I just called USCIS on March 3rd 2011, the state DPT, and finally US customs and border patrol:

USCIS: " I have no information that says that she can not fly...I would bring your marrage certificate with you to be sure and also contact the state dpt and us customs and border patrol just to be safe"

State DPT: Automated System couldnt get pass the auto system, but heard something about needing a passport and visa for ID purposes.

Customs: "If she is flying domestically within the usa all she needs is a valid passport, it doesn't matter if her i94 date or visa date is expired" I asked what if we have not adjusted status yet? "Well you are supposed to file your adjustment within the 90 days of her visa, but as long as you are not flying abroad she will be fine she is legally able to fly domestically now that she is here and she will not even come across us customs and border patrol during her flight. If she is to fly internationally you will need to be filing ajustment of status, green card, and travel documents to reenter the us."

We are going to bring along a copy of her marriage certificate just in case :)

Put the most faith in this. However, a caution: Some U.S. airports have CBP/ICE personnel who hang out at the TSA checkpoints.
