don't believe everything you read on VJ, although most is good info...it is best to always check the facts with USCIS or NVC...if anyone ever has specific questions to their case I suggest signing up for an Info Pass at your local office...

Important Notice: Effective February 1st, 2010, when both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends. If the NVC receives both an approved I-130 petition and an approved I-129F petition:

* The nonimmigrant K-3 visa case will be administratively closed.

* The application process explained below will not be available to the foreign-citizen spouse and cannot be used.

* The NVC will contact the U.S. citizen sponsor and foreign-citizen spouse, with instructions for processing the IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process, review the Immigrant Visa for a Spouse webpage.

That is not true...

In our case I also received both NOA's at the same time, I then followed the guides for both routes, the I129f was faster so I abandoned the I130 application process and my wife came in on a k3 visa.

you should not comment if you have no idea what you are talking about...

FWIW, I gotta play devil's advocate here (although I'm personally not too fond/hopeful about the K-3)...

There is one other recent case (fescobar) where both 130 and 129F were approved and sent simulatneously to the NVC. NVC chose to process the 129F (against their own published policy, mind you) and fescobar's K-3 petition was sent to the consulate. Interview successful on 27 Aug 2010 ...

Strange are the ways of USCIS/NVC/DOS :bonk: ... I'm not sure anymore whether getting K-3 is the luck of the draw or can be explicitly chosen. But the data on VJ shows that K-3 is a rarity (almost everyone else got their K-3s closed at NVC)

Seems like time would be better spent collecting the required original documents (birth certificate, marriage certificate, police report etc.) for the the CR-1 NVC steps, than praying for the K-3 which is unlikely to happen.

Awesome that you're loved one was able to come on a K3. However, clearly your case was before February 1, 2010 where the policy changed in regard to how both petitions are dealt with at NVC

No need to be rude by the way, I was commenting with the most recent info, not individual data from a specific case from 2009

if that is the case then we don't really have any choice but to pursue cr1... just wondering why they have to approved both petition if they know exactly that it will be closed at the nvc.. hopefully, we are the exception of the rule.. :unsure:

Even though they are both part of the U.S. government, they are under two different agencies. USCIS falls under Dept. of Homeland Security. NVC falls under Dept. of State. Once the I-129F and I-130 are approved and forwarded to NVC, USCIS could care less. Their job is done.

I know it sounds odd, but I'm sure this is one of many government agencies that don't communicate with each other for what ever reason.

hello everyone.. we just got our noa2 thru email today and it was dated aug. 30..both of our petition has been approved I-130 and I-129f at the same time.. I'm very happy and wondering what are we gonna expect to happen soon..we filed for a K3 visa.
