I forgot what form to file

Timeline

I married my husband who is an overstay. He is already back in his country (free will not deported) for the past two years while I curse the immigration system. He will be facing a ten year ban.....

what's the form I need to file to waive this ten year ban

who do i send it to

when can I send it.

My I-130 and I-129f are currently pending denial...doing my RFE for reapproval.

If I could be anything, I would be a tear.

You would normally bring your waiver packet to the interview or send it to the embassy.

However, I see from your timeline your interview was over a year ago, and you say you are pending denial now- why are you pending denial? If your case is back at USCIS, it may be too late to submit a waiver.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I appreciate all the information I receive so Thank You.

We have a very hard case. He has already been married and divorced.... Has been with another woman who he had three children with while the divorce wasn't finalalized yet who he never married. There is also a newspaper article that claims him to be the husband of this woman with children (so they beleive I omitted the information and asked to send them proof of the marriage) which I sent proof of them not being marreid. I was "the other woman" for some time so my daughter was born prior to his last daughter (eventhough he found out she was pregnant after he had already moved in with me). We kept our address as private as possible so our legal bonfides are lacking (but I still have a exstensive amounts of bonafides as our relationship has been over three years now). His first wife also cut up all of his identifications so he has several in the system (his signature has changed a bit and they couln't tell if all the pictures were of the same person with the copies I sent prior) They asked for two of his original documents and I willingly provided them with a handwriting sample. His elder brother's name is the same as his and they beleived that he was still here (I received a deportation letter for him 2 years after he left) and his brother was trying to get in the country on his name.

This is all besides the fact that he rushed home to see his mother after she had a stroke (just so happened to be the week after we were married). And he was a 2 year overstay of his conditional residency. They asked for an affidavit explaining specific events and so far my affidavit is over 30 pages long 1.5 spacing. So there is my life in a nutshell.

I'm doing the best I can to get him back but Im not a fool, and I'm currently completing a degree that will allow me to get a visa to new zealand or australia where he has family to sponser him.

If i get re-approval I just thought that this whole process will start again. Thus the need for that waiver (as it wasn't even an option under the circumstances) I really think he's under full-blown investigation. But he's the love of my life and my family and I will fight for him. He's just a guy that has been put through hell in situations he had no control over.

Thank you for your post I guess they will tell me if the waiver is needed.
