After submitting his packet 3 to the embassy, my fiance has decided that he can no longer go through with this process and we've decided to call off our engagement for now. We were still waiting to hear back from the embassy for the interview. What is the best way to proceed from here? Call/email the embassy to cancel the application? Just let the NOA2 expire? Any advice/options would be greatly appreciated. Thanks so much

I suggest you 'withdraw your petition'

via

fax and

email

to the US Embassy IV unit.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Any other thoughts from anyone who has experienced this at the London Embassy? I do very much appreciate your suggestion, Darnell, but I know that procedures can change slightly from embassy to embassy. Any other former Brit-lovers out there who have had to deal with this?

thanks again

Unfortunately, when relationships fall apart we don't always really hear from them any more here at VJ. You're not the only London couple to get to this point then call it off, but the only ones I know of was where the VJ half of the couple was the beneficiary, so I'm not sure what the petitioner's side is specifically from a London perspective. From their side they just let it die - don't go to the interview, etc.

If you two think you may work things out and try again, however, it is important to close this visa process correctly by doing just as Darnell says. Withdraw the petition with both the USCIS and the embassy. Have your fiance formally withdraw his application for the visa by letter to the embassy. In your letters be sure to reference all of your case numbers (both the USCIS number, his Anumber from the NOA2, and the LDN case number), both of your full names and dates of birth, and have the letters notarized. Your fiance especially should be interested in closing the visa application, because if he simply fails to show up for the interview, then he could have a denied visa on his record which could make any future visits to the US on the VWP difficult to impossible.

Are you worried that he may try to get the K-1 visa without your knowledge and use it to enter the US? If yes, and you have sent him the I-134 already, be sure to add your withdrawal of the affidavit of support when writing to the embassy. Even if he were to get the visa, he cannot adjust without marriage to you.
