I know there have been a few theads on this, but I have limited access to the net and not a lot of time to search through to find my answer.

I am in Canada and thinking of changing my name on my passport. I am only travelling on my AP so I am not sure if I still need to have my visa and I-94 when I return to the states. Does anyone know if I can get my new passport now or if I have to wait until I have my GC.

I am not 100% sure on this but I looked that up and need to do the same when we are married but I am pretty sure you can have your name change done as you are married. Even though your visa will have your maiden name on it, i was told just to carry marriage certificate as well for proof through customs. I would carry everything with you , but it should not be a problem. Hope someone else can help out on this one. :unsure:

Do you mean leaving your passport with the I-94 in Canada and returning to the US with only the AP and having your new passport mailed to you in the States? I don't think that will work. You can use just a green card to re-enter the US but I don't see where it states just an AP for a pending AOS is acceptable. You should definitely have your passport with you when you cross the border even if that means waiting until you return to the US to renew your Canadian passport in your married name.

If you mean can get your new passport done while you are in Canada and then return to the US using the new passport even though the AP is in your maiden name, then that shouldn't be a problem. Request the return of your old one - it will be voided - as it will have the visa and I-94 in it if it is requested. Your marriage certificate will connect you with your maiden name to you with your married name so you would need to present that along with the new passport and the AP. Either way, you will need a passport to return to the US, not just the AP.

My AP is in my married name, so I am not worried about the names not matching. I am also travelling with my marriage certificate just in case!!

I was just unsure when returning to the US using my AP if I was required to still have my I-94.

They'll give you your old passport back on the spot if you're doing it at one of the Passport offices - they just clip the corner off and hand it back to you. I just did the same thing in July when I wanted to renew my passport in my married name. I told them i needed it back before travelling home - even though I was going by land and had my GC with me.

Don;t have any sage advice on the I-94 thing
