Hello everyone,

It's me again. I've been doing a lot of reading & have found that many people that have had their CR-1 visa case returned back to USCIS for "further review", have received either a NOIR/NOID 2months after USCIS received their case. Should I be concerned about this? The only communication I have received from USCIS is the NOA, where it stated they received my case from DOA on April 13th.

We are now 4.5months into USCIS reviewing our case. I have checked their website almost daily and do see where they have touched it last on July 21st. I did not wait for USCIS to request any new information from me & took it upon myself to put another suppporting evidence package together & mailed it to them in early June. Of course, when I spoke to them to inform them that I had mailed them this package(they signed for it at delivery), they explained to me that I shouldn't have done that unless they had asked me for it because my packet may not get attached to our case.

Our current status with USCIS, is that I called after 126 days of them having my case with no further communication from them. The operator from the main USCIS number open an inquiry on my behalf, gave me a reference number for this inquiry & explained that at this point now my local processing office has 30days to respond back to me (by Sept. 16th). My Congress woman who has been involved since the Embassy did not give my husband a visa, is standing by to make their formal inquiry to USICS if they do not give me a status update by 180 days, August 13th.

What do you guys suggest that I do? Should I hold on and give USCIS their alloted time to respond until Sept. 16th or the 180days August 13th? Or should I bring my Congresswoman into the process now and have her contact USCIS with a formal inquiry. I just don't want to upset USCIS & possibly risk having my case go further down to the bottom of the pile, sort of speak. I'm worried... Please help. And forgive me if my topic/threads sound repetative...I'm going crazy and missing my husband terribly. The last time I saw him was in April with my children but trips back to Egypt twice a year are extremely expensive...The only time again I expect to see him, is if God willing = Insha Allah, they grant him a 2nd interview, which I will not make the mistake again of not being there with him.

Read your previous post as well. I can't give you advice about speeding up the process, as except for the NVC steps we've just allowed the process to progress at the pace the bureaucrats set. When we went through NVC it was when they were introducing the online payment system. Our age difference is 24 years. My wife's English is getting better, but due to her nervousness, I asked her to use a translator for both interviews. I'm ordering RosettaStone Filipino levels 1-3 with the 15% back to school special to help answer the language question. After getting the NOIR I answered all the points made (based on the CO's memo) and added evidence of a recent trip as well. Yes, you ran the risk of not having your new evidence added to your case by sending it without the RFE (NOIR/NOID) letter; but it sounds like it did come together in your case. I've read that some cases never get a NOIR/NOID, the USCIS just reviews the evidence (which you've added to) and reaffirms it [this seems to happen more often in MENA embassies than in Manila]. Like you, I hope to attend the interview (if the embassy decides to schedule another one) so that we'll have a better chance to resolve this without another go round. There's been plenty to keep my wife busy, so that's why I haven't put pressure to try to speed things up. I've read that there isn't much structure about reviewing returned petitions, they usually get to them when they can fit them in (giving priority to newly submitted ones who haven't made the trip to NVC/DOS for the first time). That's why it's hard to predict how long it can take. Please have a look at our timeline to get an idea of the stages of our case. Hope this helps?

9/1/10 Embassy sent letter to old address for 10/12/10 interview #3 10AM

10/12/10 Interview rescheduled to 12/3 10AM, waiting for children's NVC CC

10/25/10 Sent I-130 for children to Chicago lockbox, NOA2 1/25/11 online
