Valid I-194/ C1-d (crewman) Visa

Hi All,

I am not sure if I am posting this in the correct place or not. However,my question is I have a friend that arrived in the States about a week ago with a valid I-194 for a month and a C1-D (Crewmans) Visa. He did not board the ship the following day as he ran into a ex-girlfriend childhood friend at the airport and they decided they are going to get married befor the I-194 expires.

Now will he have to go back home(Jamaica) in order to file documents with the USCIS? I know there is a possibilty of a 10 year bar if he overstayed his time but as stated the I-194 is valid for a month even though he did not board the ship. They wanted to get married Tuesday and I am just trying to see if they are taking the correct route or not as I know you can not adjust status from a C1-D visa.

Thanks in advance for any guidence you are able to supply.

He has a month stay, he can get married in that time.

Just needs to leave before his I 94 expires.

Correct! So if he marrys as he plans to Tuesday he will still need to go back home and his wiffe will need to file papers that way?

Yes, he has no options of staying in the US. A crewman's visa cannot adjust status. Tell him to be aware not to overstay
