Hello all - at the moment my husband and I are going through the K-3 Visa process in order to gain Lawful Permanent Resident status for him. I am a USC by birth. We are also expecting our first child, and at some point after he is a LPR we would like to petition for his mother, who is of Finnish citizenship by birth, to immigrate and live with us.

I realize that since she is my mother in law that I cannot petition directly, and therefore avoid the "waiting line" however, if my husband (once he is a LPR) files the petition, we are not sure how long we would have to wait for the approval/visa to come through.

Does anyone have any experience with this situation, who could offer a general idea?

On the Petition for Alien Relative I-130 form it does state that a USC OR LPR can petition for the alien relative to immigrate.

I-485 and I-130 Timeline:

• First met online in 2001; become close friends and stayed in contact

• USC went to London in May 2008, on vacation; fell in love and began relationship

• Visited each other several times in Buffalo and London

• Engaged in spring 2009; filed for K1 Visa and this was approved

• Summer 2009 Beneficiary was accepted to 3 year Master’s degree program in the US; unable to complete K1 process at this time

• Beneficiary moved to US as student on F1 Visa in August 2009

• Lived together from September 2009 onwards, in US

• Married on April 10th 2010

• Sent I-485 and I-130 Applications to USCIS by certified mail on July 26th 2010

• 8/1/10 - Recieived return receipt showing USCIS received applicatons July 28th 2010

• 8/4/10 – Received email and text message update from USCIS – also were advised that we would receive NOA (Form I-797) via mail within 7-10 business days.

• 8/6/10 – Received Forms I-797 for all three applications in the mail.

Please someone correct me if I am wrong, but a permanent resident cannot petition for a parent. They can only petition for a spouse or a child. He would have to wait to become a citizen before petitioning for her to come. You cannot petition for her as she is not a relation.

He will need to wait until he is a US citizen. I guess you are looking at about 5 years from now before she could move.

Health Insurance is the big issue, maybe something that will be sorted by then, but probably not.

Yes only a USC can file and then it will take about a year after that. You will have to make enough to file the affidavit of support AND be able to show proof of insurance which for a health older person will be several hundred a month. Plan on this cost until she can become a citizen ( 5 years) and remember that she will not get Social Security unless she gets a job and contributes enough quarters.

This will not be over quickly. You will not enjoy this.

ditto, only USC can petition parents. you can't petition for his mother because there is no direct relation throuh a birth certificate, you have to be blood relatate. there is no waiting line for parents.

so it will take a while. first your husband has to become a LPR, then a USC and when he has had his Oath Ceremony and the naturalization certificate in hand, he can file for his mother.
