After we received a blue sheet said that our petition is admin. closed, I went to the USC and asked for more info. The CO was very rude and said that even Pres. Obama or Sec. Clinton standing in front of him, he wouldn't change the decision. I could go back to the States to rebut, refile for K-1 or file CR1.

My fiance and I were devastated and decided getting married in December 2010. We will get our marriage certificate at the same time and then file a CR1.

I would like to know if someone in this forum has been in the same position previously, what would you do? To file a CR1, what are the required documents and should I front load the package? I have traveled to VN 3 times to see my fiance in the last 8 months. We already had an official engagement ceremony on my second trip with my sister from the States. The CO said that only one family member attending our engagement ceremony doesn't meet the culture and tradition. He disregarded the relatives that I have in VN were there as well.

We have a lot of pictures together with both families. We just traveled to Thailand after finding out that they revoked our petition.

BTW, while I was in VN, my fiance and I did get all of the documents needed for obtain a married cerficate in VN such as full physical exams, power of attorney, marriage application, and my passport notorized. From the Justice Department, all I need is CONG HAM DOC THAN (Affidavit of Single Status). Do you know how I can obtain one from the VN consulate here in the US? I can get a certificate of No-Marriage from my County Clerk Office. I don't want to waste $300 for someone just to fill out the form. Thanks.

We had a similar issue, and ended up getting married in Ukraine in July last year. The USC needed just one paper to show that he was free for marriage, which he got in the Consulate, and that paper needed to be legalized in the Ministry of Foreign Affairs of Ukraine and then translated into Ukrainian. But before filing your I-130 make sure you know the reason of your K1 denial - if it still exists, the new petition can get denied.

Their reasons were 1 US relative attended the engagement ceremony is not enough, my fiance didn't know the details of the planned wedding and honeymoon even she got all of the info. except what hotel we would be staying for our planned honeymoon. BTW, we plan to travel to San Francisco for honeymoon and I told my fiance that I don't know where we will stay until we are ready to go. This didn't work for the CO. Basically, when I met him and asked why, he said that our relationship is too short and my fiance didn't know much about me (again, she knew the name of my boss and my co-workers) and they didn't feel comfortable to issue her a visa. It's amazing how they determined our relationship is a sham based on time and when here in the US, two people just met the night before and decided to get married the next day, and that's OK.

I'm sorry to hear that those monkeys at the U.S. Consulate have made you suffer; they are good at the suffering game

Take it easy. Let the emotions pass. After that, start searching and reading this forum. There are lots and lots of people in your shoes, unfortunately.

My best advice is to plan everything out and don't be in a rush to apply for the I-130 until you are truly ready. It's not as easy as following the instructions.

You might even want to consult an immigration attorney before applying. There's no point rushing to do all of that and then to be in the same situation a year later.

[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.

Cost me $350 for CONG HAM DOC THAN (Affidavit of Single Status) back in 2008. I think is very good deal.

- County clerk office to prove single status = $46.

- Going to Secretary of State to get certify = $50. (take 1/2 or full day off work)

- Send to VN/US Consulate in San Francisco or Washington DC = $100.

I only paid $350 (cover all the fees) to get my Single Status.

It is much easier to hire someone who doing this for a living, not an attorney per se. The reason why I say this is because it is pain in the butt to deal with the Vietnamese government, they always want some coffee money.
