This is a rather random question, but in the world of VJ I feel no question should/will go unanswered. So, I'm hoping someone will reply.

In the incident the petitioner (USC) can not get an original, signed letter of intent from their spouse for the original submission of the I-129f petition... is another means of coomunicating said intent acceptable? Has anyone encountered this as yet? I know many of us speak about not having seen each other in a while, so I wonder if this is something you all can shed light on? Thanks.

I sent in my original I-129F petition and did not have a letter of intent included and I got approved with no RFE although I thought I would but didnt I was freaking out when I saw that I had omitted the letter of intent....But Thanks to GOD no problem but I did make sure I have letters of intent for the interview....hope that answered your question GOOD LUCK

I believe it would depend on who is adjudicating your file. Not every adjudicator processes the same way.

I've always been under the impression that an original letter of intent is required from both parties...could he not send it to you in the mail?

I sent a scanned copy of my letter of intent to my then fiancee (now wife) who printed and enclosed it to the petition. everything went ok, approved with no RFEs.

my letter of intent didn't even say "I intend to marry within 90 days upon entry" but something like "I believe she's the lady of my life and I want to spend my life with her". no problem whatsoever.

of course this is just our personal experience, maybe it depends on who adjudicates the case.

also, when I went to the interview at the consulate, the only original signature they needed was on the I-134 affidavit of support, because it is a proper contract between the US citizen and the govt and as such cannot be a photocopy.

Unless it's absolutely impossible to get an original letter, why would you risk getting an RFE? The instructions clearly say "original statement from you and your fiance(e)". Before you file you have effectively unlimited time to gather what you need. If you file and get an RFE then you've got a limited window of time to respond, or they'll deny the petition and you'll lose the fees.

People have filed and been approved without the letter, or used a photocopied or faxed letter. Others have gotten RFE's when it was obvious a signature wasn't original. You can roll the dice and take your chances, or you can get the original letter. Unless you live in the Antarctic, it shouldn't take more than a few weeks to send an original document.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I agree with Jim, even though some people have lucked out it's better to not try your luck as well. Come over to the yardie board someone is always going to JA and may even be willing to meet up with your hunny and get the letter from him and then mail it to you from within the US. The yardie ladies and men are super nice so I'm sure someone would help if there is no other way for you to get that letter from him.
