Extending B1 in Lieu of H1b

I could use some help....

I have come over from the UK on an B1 in lieu of H1b for period of 12 months. I started my H1b application but the prevailing wage came back and this was completely unrealistic for a small company wanting the grow in the USA. So they can't support that wage level. Therefore what are the options?

I believe one option is to apply for an extension - Is it possible to apply for a B1 Extension even though its a B1 in lieu of H1b? From my research it is possible.

I have also read that applications from within the country are often denied because they want to prove you have ties back to the UK and will be leaving again. A couple of questions:

-Can I apply for this back in the UK (how long does that process take? could i just fly back for it?

-What proof are they looking for with regard to the extension if I apply whilst still in the USA....

-Flight home?

-Mortgage payments on house in UK?

-Proof I have a job commencing (with the same company after I return to uk... to be based in uk?)

-Family ties? (i have NO family in USA - all in UK)

-Letter from landlord in UK stating my lease will end at the proposed extension date?

I appreciate any thoughts... I have a consultant working on this also and she is being less than useful!!

H1's are done by Lawyers, slightly concerned that you post implies you are doing it yourself and mention of a consultant.

The B in Lieu is pretty rare, you might want to post on britishexpats.

As I understand it it is issued in limited circumstances usually for short durations. I do not believe the reasons include being underpaid.

I believe at can be extended. I see you got a year on the I 94, that is also unusual, usually 6 months.

Really this is something the Company Immigration Lawyer should be dealing with.
