Got our NOA2 on Friday...very excited to be finally going through the NVC process. Hopefully it won't take as long as USCIS.

My first NVC question:

My husband and I were just talking about costs of these next steps. Is there a timeframe on when you have to pay for the AOS? As an example, if we get our NVC case number tomorrow...can we wait a month to pay? Or is there an 'expiry date' on when payment needs to be received by?

It not what people usually do but I believe you certainly can wait to make your payment however, nothing progresses until payment is recieved and invoiced for each of the packages (OAS&DS230). Also you cant or shouldn't be sending anything to NVC prior to receiving a Paid Invoice notice on the pay online portal.

I am relatively sure on this:

once notified by NVC, you have one year to respond, you can do so either by phone or letter. Obviously if by letter, I would have it certified, by phone take names and employee numbers. I would imagine that you would not take up to 1 year, but I was told by NVC, that you have 1 year to contact or act on a approved petition. You must at least contact them. After 1 year, all fee's paid including the $355 for USCIS become void, and you have to go through the whole process again..... Anyone else heard this?

Me! Me! Me! The person from the embassy told me this on the phone when we were trying to get things cleared out with the supposedly closed K3..

Thanks alot...we wouldn't be waiting a year. It was just going to be 3 weeks or so, but this is good to know.

I have heard the 1 yrs time frame but didnt mention is because they were only speaking 1 month. What I am not sure about is when the 1 yr clock starts.

the only thing I would say is to send both your AOS and IV packages at the same time. Ofcoarse if $$$ is the reason that you are waiting, then that wouldn't be a problem, since you cannot send the package without paying and receiving the "paid" status first. The reason I say this, is I sent the AOS package after receiving the AOS as paid, a few days later the IV bill came up as invoiced, I paid that. A few days later that showed "paid", then I was just waiting for a my wife's PCC and ds-230 to arrive in the mail, (snail, and I'm talking serious Snail!) and I received a checklist! The NVC had received the AOS package, but was looking for the IV package...... Needless to you only receive 2 checklist's. If everything is not there, it gets forwarded to the embassy at that point and it's Pass or Fail, the way I read the article. 3 weeks is not much, but just pay your bills, and then send both package together after receving your "paid" status on both IV and AOS.

I would think that 1 year clock starts on the date NVC notifies you by snail or email that they have received your petition. You then must contact them at least once before the 1 yr anniversary of the date on that letter or email so that it does not expire......

But, I'm sure that most people knowing they have an approved petition and are waiting for just NVC will find a job to Shovel *#(@) if need be just to be with their loved one. I know I would.... (ofcoarse wearing a mask and gloves, boots that were like waiters........lol)
