Exactly, I don't understand why don't they consider the cash as asset?

Tom, I didn't read your entire thread. But, had you mentioned your cash asset in I-864?

Now you can see my frustration. I listed all my Bank Accounts and provide 3 months of statements for each of them. I would have though they understood people put CASH in Banks... I will give them another call and ask to speak to a Supervisor.

Darnell YES of course its all in US Banks but that might be the problem. Word is out that they are risky places these days!!!!!!!!!!! I hear you ... I hear you ... and I think I know who the confused ones are..haha

I just got this email from NVC

FINANCIAL EVIDENCE:__________________________________________

The NVC has received the information you have submitted in reference to

the Affidavit of Support. Please be advised that you, as the Petitioner, do

not appear to meet the minimum income requirement according to the

current poverty guidelines to sponsor the intending immigrant(s) for this

petition. The consular officer will make a decision regarding this

requirement at the time of your interview. In order to avoid delays, you

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

intending immigrants. To view the current poverty guidelines, visit

http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending

immigrants, please note that you the sponsor may not use Form I-864EZ

and will also need to submit Form I-864.

I don't know what guidelines they are using but I am on hold on the phone right now...

There you go Tom. The fault you made was just showed only 3 months statements. That's not sufficient. You need to provide 12 months statement.

Thanks Loto. I just got off the phone and the first person I spoke didn't understand why they stated I did not meet the poverty guidelines after seeing my assets. He said it was a mistake and to ignore it. Then I ask to speak to his supervisor who was just giving me the We have to do that speech. I told her they have to when its accurate but I disagree with the statement and she still didn't see my point. She then said well we dont decide anyway so I said fine then dont say anything. But again she didn't get it. Then I told her the US GOVERNMENT could benefit if they were as financially responsible as most of its citizens were. Hope she doesn't put any negative comments in my file... :bonk:

Bottom Line I have Case Complete and My paperwork will soon be going to the Embassy in Manila. I saw where your 2006 Memorandum stated 12 months for bank statements. I will make sure my wife has the 12 months available for her interview. What a FUBAR> Good news is I should be getting appointment letter soon.... or within 6-8 weeks :rofl:

That's a good news, Tom! NVC will by-pass it since they do only priliminary validation. Consulate officer will definitely will ask those 1 year statements, since your earned income is somewhere in the border line of the poverty line. Since you are preparing for it, you should be all set. Happy upcoming interview and keep us posted :)

After your interview, can I borrow $150K at 2% interest rate? :star:

That's a good news, Tom! NVC will by-pass it since they do only priliminary validation.
