Hello, my husband is Canadian and I am American (obviously)We got married here in the state of Minnesota where I am born and raised. We have a legal marriage and we have been married now for over 3 years. He is living in Canada, but wants to become an American citizen (dual citizenship?) I have a few questions...

1. Does it matter if he applies here or in Canada?

2. What forms do we need to complete?

3. how much does it cost?

4. How long will it take?

1. To get started, you would actually petition for him to get an IR-1 Visa. Read the guides link above for more information.

3. You can look at the current fees, but by the time he will be eligible for citizenship, the fees may change. Based on the current fees around $2000.

3. It will take 6 months or so to get the visa. After he moves to the US, he will be eligible for citizenship after 3 years. You are probably looking at around 4 years. There are some things to be aware of that can reset the 3 year clock, such as spending significant time outside of the US.

for citizenship firstly you will need to start for being a LPR. so you need to read the path for CR-1/IR1 guides here in Vj.VJ guides

and start the process.

When he became a LPR, he needs to reside in USA, most of the time. and after 3 years ( 90 days before) he can apply for his citizenship. You should read the Naturalization guide, to start watching all the requirements that he needs to fulfill.

Talking about cost, it is not an easy answer they review it at least yearly, so into 4 years who knows.

I still have one unanswered question...

My hubby is in Canada right now. Should he be in the US when he starts this whole process?

If he is still in Canada, you should start the process while he is in Canada

Otherwise , i mean if he was living with you in Usa. You should start with an adjustemnt of status. In this guides you can find both process. I mean, with your husband living abroad and lidving in usa.

Something that you have to take in to consideration is that is not legal to cross the border being a non-Inmigrant while his real intention is to inmigrate. When you are at POE if he say that he plans to inmigrate he wil be rejected and if he doens't say anithing and later start an AOS process it can be considered as a fraud.

1. Does it matter if he applies here or in Canada? He will apply in Montreal - the only consulate that does Cr-1/Ir-1 visas. YOU need to petition for him first, then the petition will go through NVC, then on to the consulate where he will apply. You are still years away from dual citizenship

2. What forms do we need to complete? You need the I-130, the G-325A and supporting documents. Check the guides for the forms - I l'll link it to this reply http://www.visajourney.com/content/i130guide1

3. how much does it cost? - you're looking into the thousands of dollars for this process

4. How long will it take? Look at 8 - 12 months from start to finish. Montreal is a terribly slow consulate to deal with
