hi all friends....

i just need your help guys,

my friend's wife has a problem with her last 3 years income tax returns,she did not file her last 3 years taxes proprly

and my questuin is this thet if she can file now for last 3 years taxes,and if it is possible,then is there any negative effect at the time of file process?

i mean to say that does the case will be weak if she is going to pay taxes now....?

Yes - she can file for back taxes - and it will only help your case getting them done.

If they request the tax info - and you don't have it, then it will delay your case, until you get it done.

Doing them late, in itself, is not grounds for problems, not having them done at all is.

Of course, this all depends on what you mean by "she did not file her last 3 years taxes proprly" - do you mean she didn't do it at all? or there were mistakes in what she sent in?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

actually she is doing job at a restaurent and also self employed too.

her restaurent job's taxes are going regularly,but her self employed job's not... that's the problem

and 1 thing is more, i heard that ,a year's income should be 20,000$,but with her restaurent job,she is not with 20,000,

but with self employed job,she is good with 20,000.

so she should file previous income tax returns that income she is earning by self employed...?

Yes - she is suppose to report all income. (even illegal income if you would believe that)

If she needs that much to sponsor - then she better get moving on the filing.

When she files the taxes late she must send in to USCIS tax transcripts from the IRS as proof that they have been filed. This is all written in the instructions of the Affidavit of Support application. She cannot send a copy of the return/s on their own. My husband filed his 2008 and 2009 taxes 2 months ago. We just sent in a transcript of our 2009 taxes and the Affidavit of Support after relieving an RFE for that information. I just checked and 2 days after they received it they started processing the card for my EAD. So, if she will be the only sponsor and will be at 20,000 for 2009, all she has to do is file all the taxes, get a transcript of 2009( Takes up to 6 weeks) from the IRS and send that in with the Affidavit of Support application. If she can, get her to call every week after filing to see if the taxes have been processed and then ask them to fax it. That takes far less time. Ours were ready in 4 weeks.
