Ok, I was told with the family size that we have which is me and my husband and the three kids that we have to go by a 5 family income which is $32,237.00 a year which that is $2628.42 a month on the income that I need to make. I know that my kids dont have an income. last year with my taxes I made a little over 2,000.00 and with what I made so far this year is a little over 5,000.00 which sucks. So I was told that I was going to have to get a joint sponsor to make up for that income that is needed. When I called NVC they told me that I could have as many sponsors as I needed to get to that income. But when I talked to an attorney they said that was wrong you could only have one. I know that I have to have tax forms, bank statements, letter from the company that i work for, and what ever else I need. He also told me that they there wouldnt be any problems for the joint sponsor for that fact that they wouldnt have to pay anything back. And he isnt understand why I am having such a hard time trying to find someone. And that you can also use, someone that is retired that is getting S.S. and on unemployment. But you cant use anyone that is getting like SSI for income. so when you add the income that is needed. How do you go about it. Do you just what what you have made to what they have made. To get that income for the year or can you had what you also got back on your tax returns also to what you have earned so far this year. I hope you can understand what I am trying to say. So like where I made a little over the 2,000.00 and made so far from work 5,000.00 could I add all of that together and put that down as my income. And then so the same thing with the joint sponsor. Is there anyway that my mom and step father could just sponsor him as a three person. Or would they have had to fill out the paper work to be able to do that. I have asked family and friends to help and no one is willing to help. Granted im not even sure fully if my mom and step dad would for sure or not they said that they might be able to. My step sister in law said that she would she made over i beleive 23,000.00 on income last year. And has worked some of this year. But got laid off. Is there still any change with what she made this year and with her tax return help me also.

first of all, paragraphs are your friend.

second, your questions are not clear to me so i'll answer what i can and if i miss some just repost them in a more clear and concise format.

third, please read i-864 instructions THOROUGHLY, http://www.uscis.gov/files/form/i-864.pdf

fourth :time:

fifth, i have bolded the info in your post which i have used in responding to you.

income/asset requirements - family of 5, you are correct in that you need 32,237. if you do not make that much you can subtract your income from that then x3 (for a spouse/child), or x5 (for someone not your spouse/child) and use assets for the balance.

if you do not meet the income/asset requirement, you will need ONE joint sponsor in your case (since there is only one beneficiary); if it was a spouse and child you could have TWO joint sponsors, and so on.

each joint sponsor needs to be able to needs to be able to meet income requirements for all person/s s/he is sponsoring (see page 3, left column of instructions). so no, both your parents could not sponsor him, only one of them.

example: 32,237 (poverty level for family of 5 x 1.25) - 5,000 (present income) = 27,237 x3 (in case of your spouse.child) = $81,711 needed in assets. or you can find a joint sponsor for the $27.237.

income - adding income from last year ($2000) to this year's income ($5000) = no, you cannot do that

if you made $2000 on tax year 2009, that is what you need to write for 2009.

i am not quite sure what you mean about a joint sponsor not having to pay anything back but am asuming (perhaps incorrectly) that you are referring to means-tested benefits? if so, remember that ALL sponsors are reponsible for the beneficiary and if s/he ends up receiving means-tested public benefits those will need to be paid back... you, as petitioner, and joint sponsors as well, are on the hook for that.

even with her 2009 income your SIL is short on income ($23,000)... you would need someone else to joint sponsor ($27,237).

i hope this helps.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

i may be wrong but i was under the impression that a joint sponsor isnt TRULY joint - in that THEY have to have the whole amount - you cant deduct your ( the petitioners) contribution and then they contribute the rest

if the way you have described it above is correct nab then i apologise for questioning you and id be delighted cause it greatly changes and imporves things for myself and my partner

ok ive just looked it up again

as far as i understand it - if the joint sponsor is a member of the household then they can add a share of the sponsorship

if theyre outside of the household then they have to sponsor the entire amount

sorry if i caused confusion

ahh! you are correct! page 2, right hand column describes that!

income/assets can be counted if they (relative, dependent) live in your household, income of a dependent who is on your federal income tax return, income/assets from the immigrant (income = only if it will continue after immigration, and doesnt need to fill out I-864A); other joint sponsors need to have the entire 125%.

thanks for correcting that, i hate for people to get misinformation!
