Hello all, my petition was approved on July 23, 2010. petition was forwarded to manila embassy from nvc (date unknown). we still have not recieved any letters, email, nothing. I contacted nvc and got the case number, but i am told the embassy has to send u appointment slip for medical. What do we do?

In other news, i was given a Nov date for completion, can that be extended? if so how? The reason for extension is the NSO office says my fiance is still married, though she was released from marriage over 15 years ago and has documents (legal stating so ) what do we do? feel like we r running out of time and have no where to turn

Yes, it can be extended. We have ours extended two times because of my police clearance from Israel. However, if you want to extend yours, it's better if your fiancee will do her medical like 2 weeks before her interview cuz the medical is only valid for 4-5 months.

She can have her medical if she already has a letter from the NVC with your Manila case number, you don't have to wait for a letter from the embassy. You can scan it then send it to her.

Hi, just to comment on your post; you said NSO - National Statistics Office said she is still married and you said you have the legal documents. Since your petition have been approved, isn't it you provide a document for her stating she is free to marry again? as for the legal documents you have; maybe she have the Court Order for the Annulment of previous marriage but they do filed it in the designated offices? When one get the Order from the Court it is filed in the Local Civil Registry -LRC where the marriage takes place and in the NSO for the proper record and documentation and CANCELLATION of the previous marriage. If they did not file it there, it will still appear in the records that she is still married. All she need to do is file the Order in the NSO, IF theydidnt really filed it. Good luck!

The problem is court filing is by attorney only and takes 6 months to a year, then u wait for the NSO to process. Philippines doesn't not have divorce in there country. Her marriage was a forgienor and was divorced In US. A judge must decide wether Philippines will honor that or not.

Did she get married in the Philippines?

Who filed for divorce? Was it the petitioner, or was it the beneficiary?

She was married in Philippines to an american and was the respondent in the divorce wich was filed and granted in New Mexixo. She has never been to USA

If that's the case, I believe that your fiancée needs to get her divorce recognized by a court in the Philippines. She will not need to get an annulment.

Maybe you can PM Pinay Wife about your case. She knows a lot about marriage law in the Philippines.
