Help with I-130/I-797C what to do next

My husband is a USA Citizen, im from Mexico and we got married in the USA april 2010, we sent I-130 on July 4th and received I-797C on July 20th but they spelled my name wrong. We have been trying to call the number they listed but says that my receipt number cannot be found either by phone or website. What should i do next? Should we send I-129F or I-485 even when my name is wrong? Ive been living with him since 2 months before our wedding i had my I-94 and visa.. but now my permit and visa are about to expire.. any suggestions?? Thank you

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Now that i read those treads we are trying to do (http://www.visajourney.com/content/i130guide2) cause im in the USA already, meaning our next step is to send Form I-864 (http://www.uscis.gov/files/form/I-864.pdf) Should we send or not the fee pointed on the form? and Can we fill it now even when my NOA has my name spelled wrong?

fee for I-864 is waived when the I-864 is NOT sent to NVC for foreign country/US Embassy review.

I suggest you revisit that guide, usually ppl send in all , at the same time. To 'just send in an I-130' is very minimal, but is possible to follow up with the rest of the forms from that guide, at a later date.

re: wrong name - sorry, I've no idea what to tell you - not on an AOS case type.

We have sent I-130 only and received I-797C NOA (with and I instead of an R on my name) I guess we should send I-864, I-485 and the 3 optional forms too, although my receipt number is not showing in the USCIS registers yet. Why is this so complicated??? :( Any suggestions???

No, it is always a machine, it doesn't have an option to speak to a person, i'm guessing that only happens if they found your receipt number, and mine is not listed yet.

You would think that if you received your NOA1 on July 20th that you'd be in the system. I honestly don't know the exact answer to your question. But I would make an infopass appointment, and go talk to somebody in person. The people on the customer service hotline have no power to change anything. But if you actually go in they can help you out. Did you make copies of what you sent? You might want to bring that and the NOA1

Sadly i forgot to make a copy of the form, but i have everything else. I have looked at the infopass but none of the options seems to be the right one, does it matter the reason i choose to make the appointment?

Probably (I've never done it):

"You need Service on a case that has already been filed "

and then

"Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment. "

What day does it say on the NOA that it was received? Make an appointment for 45 days later, which should be soon if you sent it out on July 4th

I know it says that you have to bring the service number, so it is not totally the correct number. But it is as close as you can get I think. Maybe somebody else has some ideas....

meaning i need to wait at least 1 week to try to make an appointment (hopefully it works)
