Bringing my step son

I brought my husband over on a K-1 visa and we married before his son turned 18. His son, my stepson, is 18 and unmarried and I would like to bring him from Uruguay to the USA. As I understand it, I can bring him over as a relative of a US citizen because my husband and I married before he was 18 and he is under 21 and unmarried. I am a little confused as to the cheapest way to bring him over. Must I submitt both an I130 for 355$ and a I485 for 1010$ ?

Also, if I must submitt both the I485 and the I130, can I submit the I130 first, bring the son here, and then later submit the I485 once I have the money (meaning he would be here while we saved up $) ? And, am I right that he would be considered a minor child because he is under 21, unmarried, and became my stepson before he turned 18?

I am sure you will get better answers from more experienced members, but in general the process for your stepson is different. At this point (since he is not in the US), you will file the I-130, once that is approved you will then begin the immigrant visa process, no I-485 requiered.

yup - I-130 for a CR-2 visa.

I-130 to Chicago lockbox - 355 bucks

when it's approved, it goes over to NVC

once at NVC - study this - http://www.visajourney.com/forums/topic/221785-ds-3032-slowdown/page__view__findpost__p__3560467

AOS fee - 88

IV fee - 404

once it's finished at NVC, the casefile will go over to Uraguay, interview in Uraguay.

He'll receive a CR-2 visa stamp in passport, and once he arrives in USA -

will get I-551 stamp in passport at the POE (validating his visa as a temporary green card, for 1 year)

and his green card will arrive in the mail, within 45 days of arriving in the USA.

No I-485 required.

Good Luck !

Usually, the CR-2 visa grants a 2 year green card, this card will show up in the mail, nothing to do to 'trigger' it, except come into the USA.

If your son came on a CR2 nothing else is needed, Wait for the GC in the mail. However as he is a minor you will need to go to the Local Social Security office and apply for him to get his SSC .
