How much usually do consultation services cost? I just want to get an idea so I know what to expect.

My boyfriend is currently here on a Tourist Visa but his I-94 expires on Sept 30. We recently got engaged and I am wondering what would be our options and the best way for us to be together soon. Thanks!

Here are my options so far:

a) Let him go back to his country then just get married there early next year (Jan or Feb 2010). But only question is how long is the wait til he can come back to the USA.

b) OR Get married here in the US before his I-94 expires. Will he be able to wait here until the adjustment of status is approved or does he need to go back home first and wait there? How long does the AoS take and how soon can he visit his local country again so we can do the church wedding there?

Another option is---let him return home and then you can file K-1 (fiance) petition for him; the process, albeit longer, is much more-straightforward and less migraine-riddled.

a) If you get married there - you would need to start the process for a CR-1 visa - looking at around 8-9 months or so.

b) If he is here legally - by all means - get married and file for the AOS - guide at the top.

He can stay here till he gets approved (or till he gets the AP) - which is usually given in 3 months or so, then he can travel prior to the GC being in hand.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I agree. If his life responsibilities allow him to stay until about three months after filing AOS, that's the best option. If he needs to leave, so be it. Use another option. Pick the one that matches YOUR priorities best.
