a visit to the shop does not equate to a purchase or collecting something from the shop

Well, GPS devices are expensive - if they put it on the bottom of my car, I'd sell it.

If they put another one, I'd sell it again and keep doing it until they run out of GPS units.

or let the package languish at some far away post office ....

box it up ... visit USPS .... put proper postage and an address on the box (with signature required for delivery), no return address ... oh and make sure the person is not available at the fake address to sign for the package.

Someone here is whipped.

the store may not have the wanted goods ... so what is the point of buying something not wanted?

:secret: but it's the new left that's doing it. (it was decided this january). and where is the 9th circuit court? left coast!

Just trying to crack a joke, Chuck. And as for the 9th circuit being on the left coast, that's a matter of perspective. It's only on the left coast if you look from Mexico. It's on the right when looking from Canada. :)

Case cited was from 2007. Pre-socialist revolutionary times.

when the crime was committed.

This case began in 2007, when Drug Enforcement Administration (DEA) agents decided to monitor Juan Pineda-Moreno, an Oregon resident who they suspected was growing marijuana.

case was decided this year:

After Pineda-Moreno challenged the DEA's actions, a three-judge panel of the Ninth Circuit ruled in January that it was all perfectly legal

Did anybody noticed in the Ruling the Judge comments, It doesn't apply/ Wont affect RICH PEOPLE.

The judges veered into offensiveness when they explained why Pineda-Moreno's driveway was not private. It was open to strangers, they said, such as delivery people and neighborhood children, who could wander across it uninvited.

Chief Judge Alex Kozinskiwhose homes are not open to strangers: rich people's., who dissented from this month's decision refusing to reconsider the case, pointed out whose homes are not open to strangers: rich people's. The court's ruling, he said, means that people who protect their homes with electric gates, fences and security booths have a large protected zone of privacy around their homes. People who cannot afford such barriers have to put up with the government sneaking around at night.

No truly poor people are appointed as federal judges, or as state judges for that matter." The judges in the majority, he charged, were guilty of "cultural elitism."

Isn't that a type of class warfare? let's see where are we heading, one of those latest court decision showing the bias toward the average folks, Corporation can be treated like Individual(recent supreme court decision) and their backyard is exempt from trespassing because they RICH.

Gone but not Forgotten!

Idealistic much?

What if you saw your priest walking out from an adult book store ? No assumptions, eh?

Perception is everything nowadays. Folks don't let facts change their stubborn opinions. 'round here.

Now go check under yer car for that secret GPS unit, unless Mark already retrieved it and sold it.

When tracking becomes a non-criminal issue, all of us should have a problem with it. Not having anything to fear if you've done nothing wrong is no excuse to be tracked like a tagged whale.

Keep in mind this was a criminal issue. They didn't arbitrarily pick a random guy to track. They had reason to believe he was cultivating marijuana and successfully tracked him.

walk onto property in Texas and there's a rifle pointed at you very quickly. ;)

This is where I don't quite disagree with the court. If they had the right to walk onto his property that was accessible to anyone, he had the right to deal with them as trespassers. He also had the right to search his own vehicle every day.

On a more serious note, I don't really like this, but I do understand the unconventional nature of terrorists and foreign spies, of which this is more directed towards necessitate some sort of shift in monitoring and law enforcement.

This was a simple criminal issue, hence the whole "do we need a warrant?" thing.

In terrorism and spy cases where national security is concerned, warrants aren't always required. The issue here wasn't so much about a warrant being required, it was about this taking place on his private property.

they could just avoid the entire issue about property and just tag it at work or at the mall......

Which is why I don't necessarily disagree with the court's ruling. They've long held that while "in public" (which I know his Jeep wasn't technically "in public" it was still accessible to the public) your 4A rights are somewhat diminished, especially in connection with your vehicle. You can't reasonably expect to have the "extra" privacy that you have in your own home.

Property rights are an extension of your personal rights. If you don't want the public on your property (or planting GPS devices on your vehicle) it's your responsibility to establish a barrier.

Well, GPS devices are expensive - if they put it on the bottom of my car, I'd sell it.

If they put another one, I'd sell it again and keep doing it until they run out of GPS units.

This is why I can't disagree with it. You have the right to search and operate your own vehicle every day. Heck, you don't even have to take your own vehicle to your fields, grow houses or warehouses. If you feel you're subject to monitoring, you can vary it up a little bit or use some kind of scramblers or something. GPS is not high-tech stuff.

My wife raised quite a ruckus over the last couple of years when I "wasted" all my extra money on rifles and ammo. The last few months while I've been unemployed, guess how I've been paying the bills?
