How important is it to have witnesses at the wedding especially if its a state that doesn't require a witness to be there. My fiance and I moved from GA to MD. We are getting married in MD but all our friends and his family live in GA still. Wlll this matter to the IO that its was only us at our ceremony? I have one friend in MD that MIGHT be able to come, due to her work schedule.

If the state your in does not need witnesses - then your good to go.

They may ask why people you know (family/friends) were not there - and you could just tell them the truth, you were in another state, and you plan on having a party later.. (or not :))

They are really looking to see if you two have a bonafide marriage/relationship.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I got married in California and did not have a witness. California offers two types of wedding licenses - public (requires a witness, cheaper and anyone can access it) and private (no witness required, a little more expensive and not available to the public record).

As long as your wedding is legal and bonafide then it doesn't matter if you have a witness or not. Legal is legal, regardless of each state's requirements.
