so I'll assume she was the respondent in the divorce case in New Mexico. That's a plus, really, as it means the USC Spouse filed for divorce.

You can have it extended. USEM will automatically extend it, however, it's better if you still email them, ask for extension and explain your situation briefly.

I tried email them, but their email is government use only. They do not provide a useable email or telephone number. We are very frustrated with getting no answers So please MAnila Experts sound off.

I just wanna share what i've been through. No divorce in the Philippines so the thing that she need to do is to file a recognition of divorce ,it took me 10 months . Cost 150-180,000 php . What she will get from NSO is her Marriage Certificate with annotation that her marriage is already null. Goodluck . . .

March 2009 = Saw each other again after 17 yrs. (Philippines) (Two old friends meet again ,wearin' older faces talk about the places they've been... sing )

September 2009 = Engaged / Proposed in person (Philippines)

Nov 30, 2010 = Sent I-129F

Dec 02, 2011 = USCIS received

Dec 06, 2011 = NOA

Dec 09,2011 = Touched

May 06, 2011 =NOA2

May 16 = NVC rceived

May 17 = NVC left

May 20 = USEM received (tracked thru DHL)

May 24 = Jap PC applied ( 7 weeks )

June 1 = Case entered to USEM system

June 21-23 = SLMEC/Passed

July 8 = Interview / Approved

July 13 = Jap PC picked up / sent to USEM (07/15 = Jap PC delivered to USEM) ( 07/29 = Visa printed )

Greetings!

I'm hoping that her marriage was annulled in the Philippines because its not too hard to endorsed those papers as long as the marriage was really annuled however if not then she has to see a lawyer and helped her with the procedure of the annulment. I really dont think you need $5,000 to do that job if it was annulled...I also would like to encouraged you to contact this VJ member that just registered her anullment to NSO.ALSO IF THE MARRIAGE WAS REALLY ANNULED THEN SHE WONT GET A CENOMAR BUT AN MARRIAGE CERTIFICATE THAT WILL HAVE AN ANNOTATION AT THE END AND I GUESS IT WILL TAKE TWO WEEKS TO GET IT WIHOUT PAYING 5K. HEREIS A PROOF FROM A VJ MEMBER.

Hello! I am new in VJ forum. I just want to tell you that you don't need to get petition for recognition for divorce. I am divorced to from my foreign ex husband and He filed a divorced in US year 1998. I asked a lawyer regarding on getting petition for recognition on my divorced and he told me it won't necessary if I am getting married in other country and not here in Philippines.

Are you not returning to the Philippines after your marriage?

If you will be going through the Visa process in the PH then you will need to do it otherwise you'll have problems leaving PH as CFO won't accept the new marriage since your first marriage is still valid in the PH!

I'll never understand why some people don't bother to do things the right way and then will cry foul when it catches-up with them?

Just be aware that not having your divorce recognized BEFORE entering a second marriage can cause you problems if you return to the PH...

She was married to an american and divorced in 1991, she has the dissolutionof marriage, but she still registered as married to the NSO. Told need a lawyer to correct that and will take 6 months to a year and cost as much as 5k dollars.

I do not have 5k dollars and i deploy in 10 months, also my 129 petition end date is Nov 2010. we are devistated at this......

If she initiated the divorce then the divorce won't be regonized in PI. Best and cheaper to have her get an annulment. About 2K and 6 months if done right.

Listen to the other VJ members on this. No cenomar likely means no visa. If the US Embassy started issuing fiancee visas to girls in your situation then it would cause a huge diplomatic uproar with the government of the Philippines.

Even if you did manage to get a visa, come to the US, and get married, you could be prosecuted for bigamy if you ever return to the Philippines.

08/18/2010 - AOS Interview - APPROVED!

Ok my 129F petition was abroved 1 Aug 2010. My fiance was married before but got divorce in 1991. Her Cenomar says she still married. we have be contacted an attorney and was told take about a year to change the cenomar. Not to mention 5000 usd cost, very bad news. I ask the philippine experts here for any advice they can give. Are we doomed? I am military and will be deploying next year so if she doesn't come soon will be a few years before can come... Plus the petition runs out Nov. then what? Plz help

No, you are not doomed, but you are being scammed by the lawyer. When dealing with a Philippine lawyer, nothing should be mentioned that an American is involved or the lawyer's fee and other price tags shoot up a hundred folds.

If the divorce or dissolution of marriage was initiated by your fiancee's ex-husband, I suggest for your fiancée to immediately file a petition for the Judicial Recognition of Divorce Decree or Dissolution of Marriage with the court. It should only take 3-4 months and cost less than $1,000. Remember, your fiancée must not mention that she has an American fiancé.

In the meantime, if I were in your fiancee's shoes and my interview is scheduled, I would go ahead with my interview and appear with my CENOMAR (or in this case, CEMAR) and the decree for the dissolution of the first marriage. There is a possibility that the US Embassy will honor the dissolution and not ask for a Judicial Recognition anymore. Worst thing that can happen is for your fiancée to be put in AR while the embassy waits for the recognition.

Actually Jim, USEM in Manila will issue a K-1 Visa to a Filipina who is divorced without it being recognized in the Philippines since the US recognizes the divorce and she is free to marry once in the US.

She'll have problems leaving the PH though as the CFO won't issue her a departure stamp because the don't recognize the divorce. There were 2 cases like this in that last year on VJ, 1 bribed someone at the CFO (a bit risky if you don't know them personally and illegal) the other I don't remember hearing that she was able to get out!

A spousal Visa wouldn't fly as USEM is checking CERMAR (Certification of Marriage) which would show both marriages.

Did you use your single name on your application? If you are divorced, you don't need to get a cenomar. Cenomar are for those who are still single. You was married and just need to submit divorced papers. I also ask my lawyer regarding Petition for Recognition for Divorce and he told me it is not necessary if I am getting married in other country. But if I want to clear my record of marriage and it cost 50,000 pesos and only takes 6 months.

You can ask a lawyer but be careful, I suggest you go to family lawyer or friend lawyer. Have a wonderful day and God Bless us all!

Cenomar is for those who were never married. I don't think she need to get cenomar. She just need to submit divorced or dissolution paper.

This couple just pass the interview and CEMAR Annotated with Recognition of Foreign Divorce (not needed for K1 Visa Process). I asked my lawyer too and he said it is not necessary unless you want to get married here in Philippines and want to clear my marriage record in NSO. I hope this can help!

Just want to share this:

Art. 26. All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35(1), (4), (5) and (6), 36, 37 and 38. (71a)

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall likewise have capacity to remarry under Philippine law. (n) (as amended by E.O. No. 227, dated July 77, 1987)
