I-130, Part C, item 17 - I know that I need to list myself, and my stepchildren. I also have a kid from the previous marriage who lives with my ex-wife, and she has full custody of the kid. Do I have to list my kid from the previous marriage as well? Thanks!

I am not the authority on this (other than I just submitted the I-130 myself). From What I have been told, the people you put on lines shoudl be related to you and your beneficiary.

Although I am sure someone will correct me If i am wrong!

When we filled it out..my wife's name, my name and my son..her kids weren't on the application.

oh, btw..I'm the beneficiary..I dont think the petitioner has to list their kids unless they have them with the beneficiary.

I believe in the instructions you have to list any and all children of your own whom you are responsible for even if they don't live with you. If the step children are your SO's I don't think you list them unless you all live here in the states in the same household now and you claim them on your taxes. The I130 instructions are pretty clear on it.

I believe in the instructions you have to list any and all children of your own whom you are responsible for even if they don't live with you. If the step children are your SO's I don't think you list them unless you all live here in the states in the same household now and you claim them on your taxes. The I130 instructions are pretty clear on it.

I am not sure what 'SO' means, and I can't see anything regarding this particular question in the instructions. It asks you to list the spouse and all children of your relative. In my case that is me as a spouse, and kids of my spouse living with her. My spouse has full custody of her kids, and they are my stepchildren. My own kid from my previous marriage live with her mother, and she has full custody of her.

I am not sure if I need to list my kid as well. I think not but I would like to hear opinions. If my kid was living with me then my wife would be the step-mother and then I would have to list her. But that's not the case. Thanks.

SO means significant other and I thought that attachment was where I read that I will search again and let you know. I do know that you have to include all your biological children not matter who they live with.

If my own kid was living with me and I had the custody, then she would have been considered my wife's stepchild and I would have to list my kid in the I-130 (children of your relative).

But my kid does not live with me and I don't have the custody. My ex-wife has the full custody. Does this still creates any step-child/step-parent relationship between my kid and my wife? If it does, then I have to list my kid. If it does not, then I don't list my kid.

When we filled in our I-130 I (the beneficiary) did list my biological children (even though they were older, in university and not moving with me.) I did not list my husband's (the petitioner and USC) son who is a USC.

Okay, if I am understanding everything correctly myself, fellow VJers please correct me if I am wrong...The only person(s) you need to list on the form are the Petitioner (you-because you are now the beneficiary's relative) and any children of the Beneficiary (your current wife) and/or children you may have had together.

Even though your child lives with your Ex in Russia, he/she would still be considered your current wife's stepchild, but that child would not be listed on the form since the natural mother is someone else (your Ex).

:thumbs: That is the way I interpreted it as well, as far as the children go.

Although when I filled in the I-130 I DID NOT list my husband (the petitioner) as I figured it would be obvious and redundant. We had no issues at all.
