I agree with most of that, you blamed the VWP, the Volcano, KLM etc, but you made the mistake and now are needing to deal with it.

So best to take it from there.

It will make the waiver process much easier.

Ok - thanks for the info OP.

I actually shake my head when I see people put off doing the AOS in the proper amount of time (within the 90 days of the I-94), because of issues like yours. The odds are you probably won't have any issues - but sucks if you are that small percentage that does.

The cases I have seen with VWP seem that USCIS is really going after people going past the 90 days, due to the rules of that program (no right to contest the deportation).

Sorry for your troubles - but thanks again for sharing - hopefully some others here on VWP will take your case to heart.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I read the article Boiler posted and the memorandum linked within it, and nowhere do I see that it DOES NOT pertain to VWP applicants. It doesn't say that ICE cannot do what they are doing, but I would make sure your lawyer knows about it, just in case, especially since this was issued just a week ago.
