Timeline

My fiance and I have been engaged for close to 9 months now. She lives in Canada currently and has lived there for the past 5 years. She is German and her School Visa has expired. She has attempted to file for renewal under a work permit which was denied two times even though her sister and parents visas were renewed w/o any problems....too many details to go into about that. The issue is this: She is going to have to go back to Germany now and we've been waiting for this point for the most part to start our K1 Visa. We didn't want to start until she was in the country where she was going to have the interview for the petition...where she would receive all the Background checks and verification. So while waiting these past few months for lawyers and investigations their has been a halt to our overall plan of getting married next year in May. WOULD IT BE OK if I filed for the petition while she was in Canada..(Plans to leave the country within a month) and adjusted address later even though her new address will be in a totally new country? Would she have to be stationed in Germany for sometime before we can file? What are some things that we can use for proof of address? Would a bank statement to the address suffice? Those are just the few questions I have right now. I would love to get the ball rolling on the process...just have been waiting for sometime.

She will need a police certificate from canada since she lived there for 5 years. She needs the certificate to be valid up untill the date she leaves canada. The police cert will be valid for 1 year from the date of issue even tho it doesnt say it on the paper. It would be easier for her to get one before she leaves canada, it gets harder when shes not in canada to request one and takes alot longer to get it.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

IF she is 'homed' to the Montreal consulate, then I suggest she either

move to other region of Canada or

go back to Germany, as

Montreal is extremely lagged for immigration visa appointments.

with that said - if she stays in Canada -

-get the German police certificates

if she goes to Germany -

-get the canadien police certificates prior to leaving, in person.

lawyers and investigations - what? waiting? investigations? what ? huh ?

suggest you file this week, really, and plan on her interviewing in Germany.

Can get the address changed up once the I-129F is approved with USCIS, directly with NVC (but note the small amount o time the casefile will be at NVC).

Since she is a citizen of Germany, is no 'residency' issues for her, to return to Germany -

suggest you get the Canadian police certificates, in person and face to face, before going back to Germany.

I think you can keep the 'get married in May' timeline, if you file the I-129F this week.

-Question...What do you mean by 'homed' to Canada?

-So I guess it does not matter too much how long she is in the country of residence?

I didn't think that she could even get an interview at another consulate that she isn't under. She might be able to get an interview, isn't that a more difficult process.. Especially if she is out of status while in canada...

Well she would be moving within the month or so back to Germany. I think that is what you're referring to. So by the time this is at NVC stage..she'll be in Germany for sure.

My fiance is from Egypt but was living in Saudi Arabia for work when I filed our petition. He then moved back to Egypt and I had to track our case daily after I got the approval from USCIS. I called NVC to change his address and after a couple days of calling finally requested a supervisor (Sue was her name) and had to email her a letter and copy of my fiance's passport. The consulate was changed the next day. If you can get it changed at NVC its best, because I was told that if it went to the embassy in Saudi Arabia there was no guarantee they would comply with the request to transfer the case, or how long it would take.

I was from Philippines and was living in Dubai when my K1 was filed. In the form we have chosen US Embassy in Manila, Philippines for my interview and visa process. So from Dubai i just flew back to Philippines to do my interview got my visa and went back to Dubai for few more months before flying to US. You should chose the US embassy in Germany if you are processing your K1 there.

Question - what is 'homed' to Canada ? I've no idea - I said 'homed to Montreal', which is a really nasty, evil, wicked state of being.

Seriously.

as to 'how long she is in the country of residence' - that's always fun, yes? If she is citizen of Germany, with plans to go to Germany, highly suggest to have interview in Germany - because IF she is 'homed' to Montreal, she will wait, much. If she's 'homed' to any other US Embassy/Consulate in Canada that handles K-1 interviews, hey - it's not so bad (you should find out which Consulate she's homed to, asap)

Regardless of 'interview in Canada'

--interview in Germany (she is German Citizen, length of residence not matter, globally)

--get police clearance certificates in Canada, prior to jump.

as I am CERTAIN she'll have a 'much better time' in Frankfurt, for interview.
