These are the same damn things that have been on the market since I was a little kid!

There's even a warning already out there for this about being in little kids pockets!!!

Yes, let's give our 4-year old fireworks and not use our own judgment here either.

Someone should sue this idiot for wasting the time of the judge and jury in this case.

FORT WORTH (CBS 11 / TXA 21) ― Two weeks after an eight-shot ring cap exploded in her four-year-old son's pocket, Synethia Allen said she remains distraught.

"I don't know what to think," she said. "Just, scared to death."

The cap was made for a plastic toy gun, and it exploded in Allen's son Stephen's pocket. Burn marks remain on the inside of his pant pocket.

"He yelled, he screamed, he ran," she said. "I see smoke, I take off his pants, I see skin running off his leg."

The pictures are disturbing: Allen said Stephen suffered second and third degree burns on his leg and genitals.

"It hurts, and it's a very sensitive area too," Allen said. "So I'm hoping it gets better."

Allen isn't sure if her son will have permanent damage. He receives burn treatment at least three times per week.

This isn't a new danger for parents and their children. In 2001, the U.S. Consumer Product Safety Commission issued a warning against placing ring caps for toy guns in children's pockets. Friction can ignite the caps, causing serious burns.

Allen is demanding $15 million in a product liability lawsuit against California-based Energy Club Inc., which distributes the "Real Big Shot."

"[The] industry will keep on making this again and again until they understand little children being hurt from their toys is not going to be the cost of doing business," said Kirk Claunch, Allen's Fort Worth-based attorney.

Claunch argues that the ingredients used to make the caps are volatile and target small children, as the guns often come with candy.

In the lawsuit, Claunch writes that he is troubled by warning labels on the packaging. The company that makes the guns says they aren't suitable for children under eight. But once repackaged and distributed, Energy Club says the product is safe for children three and older.

"I don't think they should even be in stores," Allen said.

Energy Club Inc. did not return a message requesting comment.
