Hi All

So im a little confused... Im a US Citizen... I got married in India in Jan 2010....

I Just now recently applied for my Wife to Immigrate to US...

I filled my I-130 application and got my First NOA...

Now my question is what kind of VISA should i get CR1 or IR1 or K3...

im so confused...

i read somewhere that i should file I-129... how does fileing 129 help me... what is the catagory of visa im looking at..

someone help me clear the smoke...

Hello

You have already started your CR1/IR1 visa by filing the I-130 petition.

The deciding factor on which visa an applicant is issued (IR1 versus CR1 visa) is the amount of time that they have been married at the time the visa is issued. If an applicant has been married to their US Citizen spouse for a period of two years or greater they will be issued an IR1 Visa. If they have been married less than two years they will be issued a CR1 Visa. A CR1 Visa will result in the applicant obtaining "conditional" permanent residency within the US and after a period of two years the applicant can apply to "Remove Conditions" 90 days before the conditional permanent resident card expires and they will be issued a regular 10 year green card.

Like the other poster said, you will be filing a CR-1.

IR-1 is for people who are married more than 2 years.

The K3 is not an option anymore as USCIS/NVC is not processing them anymore.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

CR1 is a good option. you should would be entering US as an immigrant. Like everyone mentioned you are in CR1 process.

Familiarize yourself with NVC and Consulate process.

Hey guys... i have a question...

i just noticed that for my wifes bday i made a mistake on her G325 form... and the same thing on I-130 but on the second page...

i have already gotten my NOA1 and in that letter my wifes bday is correct... do i need to call them up or send them some other paper to correct this

mistake...

perhaps they got the 'right date' then

from either the copy of the marriage certificate or (if you included it) the copy of the bio page of her passport.

regardless, they have the right date of birth.

I WOULD NOT attempt to fix this, unless you receive an RFE.

You could, of course, fill out the DS-230 properly, and explain (in a letter attached to the DS-230) that you filled out her DOB incorrectly, but the NOA-1 letter (enclose a copy) was correct.

Good Luck ! Don't sweat this, whilst at USCIS, until and IF you get an RFE (I'm betting you won't)
