Hello everyone, I came from the Philippines on K-1visa and we are going to apply for AOS ,but my husband is hesitant if he needs to submit form I-130 to bring my son here since he is to follow by early next yr. He needs to know if anybody out there has a child to follow ,what's the process? He may not need to submit and pay additional $355 ? we are supposed to send the packet this week. Thanks and God bless!

within 1 year of the K-1 visa issued, a child can follow as a K-2. No I-130 required.... if after one year, then an I-130 will be needed

Thanks for the reply, I appreciate that, that's one thing that delayed our submission for aos application, no idea if we need to submit the I-130 since we plan to get my 13 yr old son on March next yr.

Why is the AOS application delaying your son from coming here?

I will say it again... if the K-2 is applied for and received BEFORE one year after K-1 visa was issued then NO I-130 is needed. If March of next year is MORE than one year after the K-1 was issued then an I-130 will be needed

well poodles, ya dinna have any timeline filled out, so is hard to advise you, directly, based on timeline data.

but

IF yer interview date, at US Embassy Manila, was less than 1 year ago,

and IF he gets interview date within 1 year of YOUR interview date

and IF he was listed on your K-1 visa application paperwork

then

you can kickstart a K-2 'follow to join' case by submitting the packet 3 paperwork into US Embassy Manila WITH

a cover letter stating 'please start the K-2 Visa Processing'.

Usually, when 'started' in this way, can interview within 3 months of submitting the packet 3 paperwork.

Don't forget, the packet 3 paperwork is available for download on the US Embassy/Manila web site. You could download it tonight,

submit it all on Thursday.

re: 'march of next year' - once the visa stamp is in the passport, the child has 6 months to come into the USA - so you might meet yer 'march dates' if you get busy, soonish.

so, dig out yer passport, have a look at the k-1 issuance date, pull out a calendar, and let us know what's what?
