Hi

Now that i have clearer head, i wanted to further clarify the cituation. I waited for my green card for 4 and a half years. When it finally arrived it was postdated. The date on the mailer was completely different. Why would i needed to doubt it?

The officer showed me their internal document from my file with the approval, and the date on their stamp was 1 month earlier than i have on my card. I never received anything like this. Why did they accepted my app in the first place? It means it was wrong in their system too. I have to admit that officer seemed apologetic and admitted their fault, and even went to their internal laywer to maybe find the way around it... But came back and said it is not legal. I asked if appeal would help, he did not think so.

When i read instruction for filing N 400 it is clearly states:

"Date you became a Permanent Resident - Write the official date when your lawful permanent residence began, as shown on your Permanent Resident Card. To help locate the date on your card, see the sample Permanent Resident Cards in the Guide."

As much as I want to get my citizenship now, i heard that the appeal is a long and costly process, i do not have a faifh in senators either. I guess i will have to reapply and hope that one day i will forget about USCIS forever. :)

Even more confused, not that I have to be unconfused, but feel you do to straighten out this mess. If your actual date on your green card should be one month earlier why did that say just the opposite saying it was like you applied one month too early. You applied actually one month later?

Did they say your green card is no good? Did they take your green card away? Did they say you need to apply for a new green card? Or did they say because of their error, you N-400 is rejected and you have to reapply in another month. But you should be ready to apply now, as it certainly takes over a month from the time you first sent your application in to the time of your interview.

How did they explain the fact that they did indeed make the error, without you having no way of knowing that, but yet you have to pay the consequences?

I assume you have applied based on the five year no more than 90 days before the 5th year anniversary of that day since becoming a LPR stated on your green card. According to their records, you actually applied about 60 days before that 5th year anniversary date. Somebody is awfully confused.

So today I went for my inteview extremely nerviuos and full of hopes that this journey will be finally behind me. To my greatest fear the officer told me that the date on my green card was entered incorrectly by some clerk at USCIS (should have been September not August), and as a result I unknowingly filed earlier than 90 days.

He offered my two choices to withdraw application or get a denial letter. So I withdrew it. Now i have to refile, pay again, and wait another months and months.

I just can not believe it, how unfair... Why should I pay for their mistakes? Feel like in bad dream and cry. Feel like in a coma.

What a crock. You could go up the line and see what a supervisor may tell you. Also you can try calling your congressman/woman's office to see if they are able to help out.

Never ending stuff it seems...

1 month later not earlier. I guess my head is not as clear as I thought :)

Can appreciate your apprehensiveness, after all, I married an immigrant, a stranger to this country, a guest, then a LPR, then a US citizen, to her it was a gift from God, and she also was extremely nervous.

Perhaps my attitude is a bit different, sacrificed six years of my life for this country, was trained how to kill to defend the freedom of my fellow countrymen, although tempted at times to kill for my own freedom. Don't worry about that, very cognizant of the consequences of such an act. Felt like I had a right to marry any one I chose, and equally have that right for that person to live with me in my home. Had our share of problems with the USCIS, was always very nice, but feel the word is very assertive, insistent, used logic and law, and just wouldn't give up. Ran into roadblocks with the USCIS, insisted on talking to my wife, said wait a minute, you are talking about my family, I have a right to speak up. But could get nowhere with them. Also contacted my attorney, he was honest enough to say he couldn't do anything either, and it was he that suggested I contact my senator. I did, and finally got some action, even a letter of apology from the office manager of our field office.

I know how you feel, but try to contact your senator, heck, tell him or her you want to be able to vote for him.

I would HIGHLY recommend an attorney in this case because it will be an uphill battle. I think you are best served by an attorney though as they can not only work your N-400 but also the apparent negligence of the system in your case. Do not settle for what they tell you, you should fight for your rights in this case. Regardless I am sorry you were treated so badly but keep hope in your heart and your spirits high because the fight is worth it in the end :)

Thanks so much guys again!

Here is what i decided to do.

My biggest goal is to get the citizenship and as much as i want to get them pay for what they did to me it is still secondary and so is the money.

I will reapply, repay, it could be faster because my fingerprints are still valid (if anybody knows about that?). Once i am finally (help me god)the citizen, i will contact the senator and request my money back.

And I think about it like that: the law is the law and it does not matter who did the mistake, I still want to get a citizenship as it required by law, and not to have problems in the future.

It will take some more time but so is the battling with them.

You all have been so wonderful to my unfortune and i wish you all only the best!

Tristana-I'm sorry to hear about your situation....Sad, I agree....

Though it's not surprising as to how the USCIS can make mistakes like this, as they are known to do that...

Yet another reason as to why the date should be written out like this "September 8th XXXX" or "August 9th XXXX"

and not "9-8-XX" or "8-9-XX"....

Nevertheless, it is not your fault that they messed up with your application and green card, and I agree, you shouldn't have to pay for their mistakes....

If I were you, I would take your case up to your political representative ...Senator, Congressman, etc...

Do this as soon as possible, BEFORE you reapply, so that you can get some answers there, and who knows, maybe have your former case re-opened and re-considered, so that you don't have to pay again.....

They can definitely be of help and/or assistance there...

By the way, did you get something in writing from the USCIS that you withdrawn your application and as to why this was the case? If you have that piece of paper with you, then you can use that for your case too..

Citizenship is optional and there is no deadline to apply for such....

But nevertheless if you do pursue this lifelong goal of yours, I wish you all the best, and good luck on your journey.
