Hi all!

Sorry if I'm spamming but I know a few of you wanted to know what was the stats on my situation, what happens after they reject an I-485 petition but keep the I-130 and also I am hoping that if anyone comes along in the same unfortunate situation that they'd have a reference.

Hubby and I went to the InfoPass office today and first thing I have to say is that everyone was extremely nice! I didn't know what to expect so I was expecting the worst. But it turns out they were kind and helpful.

The lady at the office told us to go ahead and file a NEW (since the one USCIS rejected has been scanned and marked) I-485 together with I-765 and also add to that a copy of our I-130 and explain on the cover letter our situation, that the I-130 was still with them but that they had returned the I-485 so we were now filing for it.

She also said not to add any payment for the I-130 because eventually both forms are going to meet up.

Sounds like everything is not as terrible as I had foreseen and now it's back to filling and printing! Hopefully we can re-send this by tomorrow. :)

Seems like my journey isn't meant to be an easy one.

The Post Office attempted to leave the package but apparently nobody at the office was there to receive it so they left a notice.

Does anyone know if USICS will actually contact the Post Office to get hold of it? Or any recommendations on what should we do?

On a much happier note I received text and e-mail yesterday that our I-130 was received!!! Finally!!! :dance:

P.S. I :just: checked and USPS was also able to deliver the package later. Wow. Now I feel so much better. The waiting game begins. :)

yay!!!good news! :star: I am sure they will pair your I-485 with I-130 soon, they have to, because they can't make any decisions on your I-485 stuff unless you have a sent I-130 and they will have to look for it and find it. Whenever you receive the I-485 receipt notice-that will be the good sign! :star:

I think I have even more questions!!! I received the NOA e-mail and sms last week, now reading back on that I notice that my case files were sent to California??! My husband and I live in Virginia and we wrote that on the forms. Why would they send it to Cali? Anybody's got any clue??

"Your USCIS application/petition has been received and routed to the California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797)"

Maybe since there is no I-485 with it, they assume it is for a CR-1 and are processing it accordingly? Any news on the re-sent 485?

And for CR-1 they are supposed to go to Cali? On the USCIS webpage says to send I-130 (even if filed on its own) to Chicago Lockbox and that it'll be forwarded to your USCIS office (Ours obviously isn't there)

Answering your question, no, I haven't heard from our I-485. =(

Well, I am not sure where CR-1's go... someone else will know... but California is a huge Service center, not a local office for interviews. So I thought from the lockbox they distribute the paperwork to the "appropriate" office, not the local one (at least not right away). The concurrent I-130/I-485 is processed in Missouri. I am guessing that once they find the I-485 they will probably find your I-130 and then send it back to Missouri. Just making educated guesses here... no real data... throwing out ideas. But we have to assume that they would not know about your missing 485 and would start to process your 130 as a stand-alone petition. Hope they find the 485 soon!

Thanks for your reply! My I-485 just got rejected (again) :sigh: This whole thing is going to start making me cry. :crying:

Oh no! That's bogus... Maybe make infopass again... or call the hotline a few times... (make sure you get a consistent answer or get your call escalated). I once called there and actually got to someone called "officer" who knew what he was talking about, and all the operators gave me wrong advice. I started by saying "I received some advice before that was misinformed and I'd like to speak with someone who... blah blah blah." Good luck!!! I suppose the worst case scenario is that they'd approve the I-130 and THEN you'd have to do the I-485. When you sent in the second I-485, did you include a copy of the email from your NOA1 with your case# on it?

Nope. The I-130 was Notified the day that the second I-485 arrived at Chicago, we asked the Infopass lady if we had to wait, and she said no, she said to just add a cover letter explaining, which we did.

I came to terms with waiting until I received the physical I-130 NOA and then I'll re-send the I-485 with a copy of that. :)
