August 2010 - CR1/IR1 Filers

Yesterday (24th Jan) was our 5th month after our NOA1. Still nothing since Nov 30th, which was when it was transferred from California to Texas. We've refrained from calling until today. As I type, my wife is on the phone to them and the guy on the other end is checking their system. He did initially say that the 5 months begin again from the Texas transfer, but that was soon corrected (Phew!!).

He said it still shows we have 7 days within the normal processing time, so there's nothing he can do at this point. So he said wait 8 days and call back, at which time they can put in a service request. So assuming that's working days, we can call back on Feb 4th.

Hopefully this waiting will soon be over.

From your timeline I see that

2010-08-20 - I-130 Sent

2010-08-23 - I-130 NOA1

It is not possible to get an NOA1 date 3 days after you send the package. August 23 is most likely your priority date. The NOA1 date is the Notice Date on the top right of the notice. That is the date they look at. So that is why he most likely told your wife that you have 7 more days remaining.

Sorry, I think you asked this before, and I forgot to respond! Yes, I stayed at CSC (thank God). I was one of the first lucky ones with a September NOA1 date to be approved after all of the June/July/August filers got screwed when they were sent to TSC :-/. I really do feel for all of them, but I can't allow myself to feel guilty, bc I didn't actually do anything to get my file pushed ahead--just got REEEEALLY lucky!

I'm so excited about our interview next month (less than 4 weeks!)--I'll keep you all updated! I'll also continue to check for updates here--I wish nothing but the best for my fellow August/September filers (and for everyone else waiting!)!

I also called today and she told me to call 27 th of January again.If I don't hear anything by Thursday when I call,she is going to put a service request.Also told me we are on the final stage.

What Notice Date (upper right corner) do you have on the first I-797C? That is your NOA1 date. Clock starts ticking for that date.

That's strange, because in our case our priority date was August 1st and NOA1 date was August 11, so when my hubby called to open a SR, an operator himself offered to open it because he said we exceeded 5 months limit, he was counting from our priority date, because there was like a week left till our NOA1 5months date. So I don't really know if they really count since NOA1 date! In our case it was priority date! Maybe if they do not want to open a SR for you, try to call once again and speak to another operator.

Hey, we got approved on november 23rd, and waited. then after two weeks, we emailed NVC, and they told us they hadn't received our case, and I had to scan a copy of our approval letter and email them again. then waited, and on January 14 Th., we got our emails from NVC with our case number and information.

so I would wait a few more days, if you only been waiting ten days, but I would say 2-4 weeks before NVC will get in touch. but definitely email them, and get things moving.

Just got approved! Got the text message at 4:44pm EST and immediately went to the USCIS website to find that our I-130 finally got approved! We were just a few days shy of the 5 month mark. Good luck to everyone else still waiting!

She didn't get expedited. She was one of the lucky few that got approved early!
