Hi,

Got married recently in the US(2nd marriage)and I'm back in India ... we are in the process of filing for the CR1 visa. Wanted your input on the following:

1. The marriage certificate has my earlier married name on it as that's what was on my passport. Can i put my new married name on the petition?

2. Should i get the name on my passport changed to my new married name?

3.What name should i put on the forms? If i want to put the married name do i have to wait till i make the changes on my passport and then apply?

Please let me know.

The visa is going to be issued to you under the same name that is on the passport.

You can put your Married Name on the I-130 petition now and there will be no problems. You do not have to wait to change your name. You can send the I-130 petition in now and start working on getting your name changed on the Indian Passport, bank account and other documents afterwards.

By the time your I-130 is approved you should try to have the following docs in your Married Name: Indian Passport, Police Clearance Certificates. You can also change names on Voter Cards, Bank Accounts, PAN Cards, Phone Accounts and other documents if you wish, but they are not required.

Also when you change your name in your passport they will give you back your old Maiden Name passport (canceled). Keep that canceled passport with you to take to the interview along with your new Married Name passport. Also if you are making a new passport in your Married Name, add your Spouses name into the Bio Page as well.
