Hi Everyone,

I was wondering if I could get some advice for a family friend. My best friend's cousin is 16 years old and several years ago both his parents were killed. Now my friend's family want to adopt him and bring him to America, but they don't have any idea where to start. How long does it usually take for cases like these? What application process do they need to go through? How old does he have to be? And, at what age will he no longer be eligible? Any help would be much appreciated.

Sara

If they adopt him and all the legalities are completed in home country, then I dont think it would be much complicated as he is minor and is legally adopted, that would bring him in category of UC's children.

Someone can correct me if I m wrong.

He seems to qualify as an orphan, which is key to being adoptable and immigratable There are adoptions that are not valid when relatives adopt , as these are seen as a way to circumvent the laws. There is also an age limit and I don't remember if it is 16 or 18 . Someone will know that.

The I-600 needs to have been filed before the child reaches the age of 16

Oh, no. Is there any other way to bring him here now that he is 16. He has no other family to take care of him.

A student visa ? is he eligible for the green card lottery ? ( not that there is much chance of winning )

For green card lottery, an applicant has to be 18 or older. Certain countries are excluded because they sent large numbers of immigrants (more than 50,000) in the past five years - Canada is one of them.

Go for the student visa.

Wasn't sure if the "best friends cousin" was also from Canada

No, he lives in Iran. This is bad news. :( We were really hoping they could adopt him.
