Here is my wife situation...! I-130 approved on 7/13/2010. I wasn't expect that NVC sent the AOS FEE BILL and DS3032 because F2A category. Anyways, I paid AOS bill and talked lots of folks at ITTRACK.COM..didn't get help much. Talked to 2 laywer about the upcoming baby that how i would add him in the same petition. two different view: 1. Just wait till the baby born and filed I-864 with babies birth certifcate. 2. Go ahead submit the I-864 with ultrasongraphy, doctor's letter and possible date of your child born., Then I called 2 times NVC: 1. Sir just wait till baby born and file the rest of papers with babies birth certificate. 2. You can file the I-864 with baby's possible date of birth.

I was inpatience and chose the option #2.

But, I have an issue about poverty guidline, I have enough last year income for one person(125% of Poverty Guidline), since i add the baby's name i filed tax amended(increase my tax return of 2009). I tried to get tax return transcript copy of 2009, but IRS told me that I couldn't get Tax return transcript copy because of Tax amended takes about 12-16 weeks to process( I screwed myself).

Well after research in the web, I have arranged different way to submit I-864, I have sent a copy of 1040 with W2 & additional income source statement, Employment letter, last 3 months pay stub and Bank statement. also added Baby's pssible born date with ultasonography, pregnancy test report and Doctor's acknowledgment letter.

My question is that, Do you guys think I should not submit DS230 until I got my tax return transcipt copy? I know that Last tax return is very important for Bangladesh Dhaka Embassy without it, they will ask to bring co-sponsor.

I have tried to expedite IRS Tax return process, they just simply denied it......(suckz IRS)

i'm terribly sorry, but I don't understand what is what.

you mention an i-864, but then is some issue about a child?

focus on 'child's status' first - ie -

if you qualify for 5 year rule as us citizen, then can file the Consulate Record of Birth Abroad,

then if filing I-864 to NVC NOW, unborn child not count.

on interview day, if child is born already, then submit NEW , updated I-864 packet to US Consulate, on interview day.

so 'child' is increasing yer headcount on the computations for the I-864, right? OK - got it...

are you adding cash or assets in for computation ?

or

maybe is time to get co-sponser / joint-sponser, since (as you say) you are 'borderline' even with just 1 person.

Darnell firstly, thanks for your prompt reply.

I made last year only $19,850.00 which is covered for my wife. I know that my child will born in septmeber( next month) which my wife has to take interview with him. According to poverty guidleine for 2 person you need $22,850.00 which will not cover my child. As i mentioned that I filed Tax amended(increase my tax) which i can beat the 125% poverty guideline, so US consulate at Bangladesh will not have any issue for that. Thats reason I called NVC if it is ok if i submit I-864 with baby's possible date of birth, one person said ok, another person said hold onto baby born and submit it. But i do have the 1040 which is showed the new tax amended iformation, but I do not have the tax transcript for that because it is still in process.

I still haven't receive my IV FEE BILL yet, look like when i receive it i will hold until my tax transcript in hand and submit DS-230 with baby's birth certificate and required documents.

Another frustration about Tax amended filler. I just informed by IRS that Tax amended will not effect or change on the tax transcript. Its always shows original tax where 1040 was first filed(screwed again). The only option that i have, to take amended 1040 tax return to the IRS local office and make them notorized it. My frustration is that In bangldesh embassy will not accepted any notorized copy from IRS, only accept original transcript with envelope sealed. This is crazy....We just suffering for those bangali who used fake tax return and caught in the embassy..what a shame..

Miami - it DOESN'T MATTER how much you made last year. All that matters is what you make NOW. One could make $0 in 2009, but as long as has enough income (125% +) now, there is no problem. Of course, you need to provide documentation that you make what you say you make.

And, why are you complicating matters with "amended tax" and what not? Why did you file an amended tax return? What was wrong with your original filing?

Also, why are you worried about the US embassy at Dhaka reviewing your AOS docs? AOS is processed by NVC.

According VJ forum and spoke to couple of BD user, US embassy dhaka must want your last year tax return transcript, which mine wasn't show enough income for 2 person(good for my wife-$19850.00), since adding my unborn child I need $22850.00 poverty guideline 125% for 2 person. So i filed an amended tax for that year. Yes, I have submitted my recent job status like pay stub, letter from employer and Last two months bank statement. I know that i will smoothly go through at NVC, but US embassy Dhaka which will not accept a copy of 1040( which showed my recent AGI), even it notorized from Local IRS office.
