Could I get some opinions on this?

Luke I just got in today and had the following email from CSC. It appears the case has been pending since 7/6/2006 and they suggest it could take as long as 60 days from that date. If you don’t receive a notice by 9/6/06 let me know.

This is a pretty typical response we've seen on the board. It just means that your RFE was recieved on July 6th and that within 60 days you should have your NOA2. I highly doubt it will take the full 60 days.

You are in the same situation as most other people here although some of the prior emails received directly from CSC indicated 30 days (many of those petitioners, however, were not approved in the 30 days following RFE receipt). It appears that your congressional contact simply forwarded the CSC response to you.

There is no way to tell how much longer this process will take. Several members have unfortunately received second RFEs delaying them even more. Technically your congressional contact can make an inquiry on your behalf every 30 days but they are not required to process within the 60 days stated.

What is not cool is that your about 140 days into the process. Then we see people approved in less than a month. We will not be with our loved one at christmas when people filing 3 mths or more months after us may. We are in the same situation, my NOA1 is 3/29. Currently there is a congressional inquiry on mine also (yea, supposedly the senators office to but to no avail on any information). I guess this is what I should look forward to in the next couple days......sorry.

Pray we both get taken care of soon.

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

hi, I've seen several similar comments from you & wondered if it would help you to know that while timelines from others are useful, it's crazymaking to expect that your case is like any others.

Your name, your fiances's name and a thousand other details are unique to you. They do not come to your case, start working and pause all else until your details are resolved---cases filed after yours may indeed get approved ahead of you, which is normal.

Normally, the Service Centers won't even look at your file (whether you ask or an elected rep asks) unless the posted processing date is 30 days past your NOA date.

An RFE at this point would indicate that your file is on an officer's desk under review, which is a major step forward.

I think the problem here is that it absolutely KILLS those of us who filed in March and got caught in the IMBRA debacle to see people who filed in June sail right through. When we (March filers) sent in our paperwork, all in order and correct, along with the fee, one thing we expected was that processing would go in the order received. Of course each case is different and issues do come up. But in this situation, the very fact the RFEs were not sent out by NOA1 date has hurt us immensely. Now not only are the original NOA1 dates even being considered, they were not considered when RFEs were sent out and it's not clear if RFE return date is being considered either.

So while we clearly need to take in account that each case is different, the rest of this IMBRA fiasco has completely overshadowed that as well as blinded us. We are just mad and super tired of waiting and feeling like we've been screwed due to USCIS error. :(

As someone who just filed this week, I agree, I think it's absurd that some people with March NOA1 dates are still waiting for news while people are getting approved in as short a time as 15 days. Sure, each case is different, but the fact of the matter is I think that CSC and VSC should have stopped looking at new cases until all the IMBRA backups were cleared through.

Yes, I know this would be damning myself. But it's only fair that everyone who got caught up in IMBRA would have a chance to see a reviewer before those of us that filed later would.

For Meauxna, if people are being approved that submitted AFTER the IMBRA RFE was received back to USCIS, you have to admit its wrong to approve those first. They are in essence cutting in front of even our new dates. You will not convince me that 'every case is different ####### anyways'. Yes they are, but in order to approve the case, it has to be worked. When they are working on things coming in after ours, as well as after the requested information, then it only pushes the process further back.

For that matter. I shouldnt say this, but I will. Those that know our frustration could be a little more understanding...the 'approved in 15 days' or 'i love the vsc' is unnecessary. You are approved, congratulations. Dont brag about the short term when we are suffering and having to tell our fiancees to be patient.

seeing all these extra RFEs go out... my latest semi-irational fear is that by the time they finally look at our file again, they will decide to send us an RFE at the time my feller heads off to travel (work) for 5 weeks. It will languish in his mailbox and put us that much further behind.

I can totally empathize with how you both are feeling. Even though I just squeaked through before IMBRA, even back then it was annoying seeing people going through the VSC getting approved in 2 weeks while CSC people were waiting 90 days.

Now that everything is thrown out of whack, I would seriously be pissed off seeing people getting approved in two weeks when I had been waiting 5 months!

All you can do is hang in there, and keep waiting. Just think, everyone that get approved, is one less in front of you.

Be patient and hopefully you will get your approvals soon!
