Engagement party before Divorce Final

Timeline

Hi.

In 2001, I petitioned my fiancee from Vietnam. We got married in the US and the marriage lasted 8 yrs and we had one child. In Mar 2009, we separated when my wife moved to another state. In Sep 2009, I filed for divorce thinking it would be over in at the most 3 months. Also, around Sep, I started talking to my present fiancee, also from VN. My present fiancee was introduced to me by my friend (my friend is her cousin). In Nov 2009 I went to VN to meet my fiancee for 8 days. We got along great and in Jan 2010 I went back to VN for 2 weeks for our engagement party. Unfortunately, my divorce was not finalized by then. It was not until late June 2010 that my divorce was complete. Do you think having an engagement party before the divorce was finalized will give us any problem at the consulate level? If so, what can we do? I already filed the I-129F and received the NO1.

I think you need to do a lot of homework here. Just being in a divorce and finding a new babe and asking for a K-1 is a huge red flag. Be sure to start documenting a very convincing relationship from here on out. I am sure they are going to frown on getting engaged before you were even divorced.

They had issue with the fact that we had agreed to marry before our divorces were final... We waited until after they were final to have the Dam Hoi, but the CO brought up the question, how do you get engaged to another person when you are married... The CO's look at dates in a timeline to see the flow of the relationship... if anything seems to have gone too fast then they look at that as a red flag... Our interview was 6 months ago and I blame being in AP on the fact that the previous relationships had not been terminated legally prior to our starting our relationship...

They could have the following issues from what I see in your post and timeline:

1. short relationship before filing petition

2. only 2 visits

3. began new relationship before divorce

4. filed petiton for fiance shortly after divorce

5. previous spousal visa filed by petitioner

6. introduced by family member

They will take a close look at this petition... dont be surprised if they call you from NVC asking for your ex.... or if they make you jump through additional hurdles at the consulate
