Have a 2 yr green card, traveling to Canada in a week for the first time since arriving to the U.S. with my fiance visa in May 2008. When and who do I give my I-94 to? Do I need to bring my AP with me or am I good going with my Canadian passport and U.S. green card (expires in March 2011)?

I-94 is turned in on interview day for AOS.

re: crossing the border - need passport and greencard.

if greencard name not match passport name, bring marriage certificate to show.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

No need for an AP with the 2 yr green card. The 2 year GC has all the same benefits as a 10 yr GC but you do need to take into consideration how long you will be out of the country in have withing the 90 day period prior to expiration you need to have the conditions removed.

The instructions on the back of the I-94 say that if you're leaving the US at a surface PoE into Canada, you give it to the Canadian customs officer on the Canadian side of the PoE when you enter Canada.

Since, as was stated above, the I-94 is surrendered at the AOS interview [when there is one], it is a matter of some question whether K-1 entrants who AOSed with no interview need to hand it back, or if we can just keep it.

In my opinion, the instructions on the back about whether and how to hand it back seem clear and unambiguous. Last month I had to go to Japan for a week for work, my first trip out of the US since getting my GC, and I made a point of handing it back to the airline representatives, as it specifies.

Your AP documents became null and void (not to mention completely unnecessary) the instant your GC was approved. Don't bring them on your trip, and don't try to use them at a PoE. Just put them in with your other immigration stuff as a keepsake. You don't need them anymore.

I didn't have an AOS interview, so I'll just give it to the Canadian customs when I cross, since I'm travelling by car. My last name doesn't match on passport and GC, so can I bring a copy of my marriage certificate or do I need an original?

A regular photocopy should suffice, I think. Having differing surnames on the GC and passport is a very common situation. But if an original can be had for a reasonable amount of time and effort, I would bring an original. No sense being underprepared. If <30 minutes and <$30 can eliminate any possible risk of hassle, it's worth doing.
