Timeline

I visited my fiance in Hanoi in July last month. I receive word that she is pregnant. First of all words cannot begin to explain how happy I am that I will finally become a father. It is the most amazing feeling any man can ever have. But I do worry little bit because we just filed the I-129F petition yesterday and my fiance worries that it could be a problem for us at the interview. We think we could have the interview very close to when she can give birth but now it is very early to know anything about that. Do anybody had experience with the fiance being pregnant for the K1 interview? And can it be a red flag?

Sent the I-129F petition to USCIS on Aug 20, 2010

I-129F Approved!!! Feb 7, 2011

Returned P3 to Consulate Mar 7, 2011

Interview Date May 20, 2011

this should be a green flag not red flag

CR1 timeline:

11/2008: submit I130

11/15/2008: case sent to CSC

06/02/2009: uscis approval

08/05/2009: interview-get blue slip request timeline

08/25/2009: submit timeline - get denial blue slip

Thank you for the response. I guess I become a little worried because somebody told me that it is bad to have be pregnant if you do the K1 visa. He advise me that if you have a baby, I should do the CR1 visa. I cannot do that now because I just started the K1 process. Does anybody else have experience on your fiance getting pregnant during the K1 process?

Timeline

It is all about proving a bona fide relationship. Being pregnant does not make it any faster or easier.

If the baby is born before the interview then your household count for the affidavit of support goes up by one. Also you would file the Report of Birth Abroad for the child.

Thanks for your advises. Yes I am now learning about the report of birth abroad. Yes being pregnant does not make it faster. Do you think the CO will deny my fiance because she became pregnant? That is my main concern that they will deny her because of this.

Her being pregnant will not be a reason for any denial.

A friend of mine had the same like your situation but he found out before he filed K-1, his baby was born in the US. He is a member of VJ, search for Bill name. I'm not sure if you need to notify the USCIS right after you receive the NOA1. Good luck and Congrats

I had sex with my wife before we got married. It's the 21st century. Things like that can and do happen ;)

1/10/2010-----> Mailed I-130

1/17/2010-----> NOA 1 - Hard Copy

3/28/2010-----> NOA 2 - Email

4/02/2010-----> NOA 2 - Hard Copy

6/14/2010-----> NVC Processing Complete

8/02/2010-----> Interview Date @ 8:00am - Result = PINK!!!

If she's close to deliver the baby by the interview date, she'll likely be asked to submit DNA testing results (more than 90% chance). They (the C/O) already had many cases in the past in which the babies belonged to someone else than the petitioners'. Be prepared to prove to the Consulate it really is your baby. Everything in Vietnam is Fraud, until proven otherwise.

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!

In the 21st century, people (assuming those who still strictly observe their religious believes) still abstain from having sex until AFTER the marriage. Especially when the family has properly taught and raised their daughters when they were still young.

But again, we're talking about those whose primary interest is to immigrate to the US and having babies is the only sure way to secure their purpose.

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!

How do you no she was not married before? I talk with my fiancee she wants to have my baby because we love each other, granted we wont have one till she gets stateside. Your generalizing a bit when you say they have babies just to immigrate.

Friend of mine was in the same circumstances. Turned out the child wasn't his after 3 years in the US. He had DNA done. Divorced now. Happens more than you think.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

The problem is that this tactic is based on a widely held misconception in Vietnam that having a baby together will greatly improve your chances of getting a visa. The Vietnamese mindset is "How can they say the relationships isn't 'real' if they have a baby?".

Make no mistake - the Vietnamese people are not naive. They know darn well that a couple can have a baby and the relationship could still be a sham, but they somehow think that the consular officers are substantially more naive than they themselves are. Countless girls with a bun either in the over or in the basket have left the consulate with a blue or white paper, but somehow this isn't enough to kill this myth. My wife heard it too, from many people.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
