my husband and i met online in Nov2008 and we married March 9,2009. I stayed 2 weeks that is all work would allow. Then as soon as i got back i started to search of how to do papers because i had no idea of what i was doing. We married because we love one another not for papers. Well I hired a lawyer and it was the worst thing i could have ever done. She did a K3 visa. Don't any one do K3 it is the worst. I was told it is in fact obsolete now. I know it was a mistake now. We got recieve date May 15,2009 and notice date of May 20,2009 for I 130 and we get reciept date of June 2.2009 and notice date of August 27,2009 for I 129. Then we get letter of interview dated Sept 5,2009 and interview is set for December 1,2009. I am there with my husband in interview time again I stay 2 weeks cause of work. We go to interview December 1 and they interview him and I. They play with us and say oh we may give visa maybe another interview. We get phone call we have another interview for December 10, 2009 then they say false relationship and send papers back for review using 221g. Lawyer did nothing to help. When i am back in US i talk with her she just keep tell me oh you must just wait. I didnt wait i have wait long enough. I make many phone calls and find i can do cr1 visa cause i have an approved I 130. So i file this and we pay fees and send first packet in end of Feb and second packet ready to send in first week of March. Just as I am ready to send this i get an email saying all has gone to the USCIS for review. So i dont even get to send second packet. Now we are told oh it will be 120 days it is now 5 months and 2 weeks and we are still waiting. We have been marry year and half and still apart. I was just there in June again to see my love. This wait is killing us. I have worked with both senators, send emails, letters to 6 different offices in white house and state goverment. I make phone calls so much now that one senator office say we will call you back. Only infornmation new i have is that they say we are in que for officer in USCIS. I need to know what else I can do. I have tried all i know. If you can help us plz do. I can give you more details if you contact me.

First, I am sorry that you are going through this. There are several of us in your boat. Morocco is a high fraud consulate and they send back a lot of these petitions. It sounds to me like their issue is that you married him the first time you met him and were only there for two weeks. Which means, you likely began making preparations to marry him when you got there. This is a HUGE red flag for the Moroccan Consulate. There is a warning about this posted directly on the Consular website.

You need to prepare a packet for rebuttal to USCIS in case they send you a notice of intent to deny. Have affidavits written from family and friends (yours and his) attesting to what they know of your relationship. Get together copies of boarding passes and any and all receipts and pictures you can find from your visit. Gather phone and chat records too. If they send you a NOID, then you will have to prove to them that your relationship is real. At least with the CR-1 you will have an opportunity to do this. At this point, unfortunately, there really is nothing else you can do to speed it up. Just gather your evidence and wait. After 180 days from the day your CR-1 arrives back to USCIS, then you can ask for a service request from USCIS. Good luck!

Thank you for your help. I would like you to say we had planned our wedding before I went there. But of course the consulate doesnt care about that. We took much proof and they even interveiwed me and the officer never looked at any of it. He only looked at the packet that arrives before you come for the interview. He choose my husband right away to not get his visa because of the city he is from first and he didnt like my age. He even said so. I have filed all of this of our experiance with the inspector general and I the other offices.

I would like to know also is if they choose to send NOID do I need a lawyer for this. Every one here is trying to scare me and say I cant do this myself and I am not happy about lawyers right now or trusting them after getting ripped off and told to sit and not do anything but wait. If I had done that we would not have a cr1 visa filed like we do. Because I took the initative to search and see what else I could do.

That is a big red flag with Casa getting married on the first visit and a short engagement period. Also a big age difference is a red flag usually you being older than him 10 years + I am sorry you are going through this and hopefully you will get some answers from some here who are in the same boat. As for me I am just now getting ready to apply for my husband. I wish you the best!!!

I really can't advise u to use a lawyer or not. I am debating this issue myself. What city is he from? And how much older are you than him?

Sorry that you are going thru this. I doubt that people are trying to scare you. The reality is that you do have an uphill battle. I don't know advice for your specific situation. But I would say that it would probably benefit you more to look at the situation more holistically rather than blaming the co being predujiced against your husband's city. You mention huge red flags for fraud in Morocco. They are your age and your quick marriage. It's not considered a positive by the consulate for you to say that you planned the wedding prior to meeting.

It sounds like your co mentioned the age difference. I believe they are permitted to mention this because it's a red flag that is outside of the cultural norms in Morocco.

The bad news-you have red flags that you mentioned here....the age, getting married on the 1st trip to meet him and meeting online. Your "true love" may seem real to you, to the consulate it seems like "fraud".

Lawyers can not do anything for you. If they promise you a "miracle" they are most likely full of it.

You will have to wait for USCIS to review your case, it could be a long wait(not wishing this on you)

Worst case scenario is that they can revoke the petition but you could most likely refile a cr1.

Be prepared, you already know the possible reason for denial. In the mean time try to keep visiting your husband and building that "true love"

There is a light at the end of the tunnel.
