The reason I was arrested and deported is I failed to notify USCIS of change of address.

Did they pick you up for this reason, or did they actually deport you for this reason?

Everything I have ever read about removal under section 265 of the INA indicates that in the abscence of other immigration violations, it has historically been reserved for offenders who were believed to be a risk to national security.

Whilst I am pretty awesome, I do not think that was the reason.

I had plenty of photo's with me, I was watching others going through that day and it seemed I was not alone.

I am sure it varies significantly by Consulate, like so many things.

I was in the country illegally. They had said they would send me summons to appear before the deportation judge and before I received the summons I moved.

This is a brand new experience for me and I wish I had researched some more before going for the K-1 visa interview. The way they said it in the letter sounded like I was just going to produce the paperwork they wanted and bang! I would get the visa. Anyways, now I know the easier way out is to get married.

Any ideas where to get a cheap air ticket Atlanta-Nairobi-Atlanta, as soon as possible? I have been here one year now and I was so hopeful... Looks like I'm going to stick around a while longer. God help us.

deportation means a denial at the interview ( automatically if the deportation is less than 10 years old ) and then you ( the USC part) has to prove hardship and get a waiver approved. No mention of a waiver yet because they accused you of attempted immigration fraud. You may want to look up immigration2us net ( fill in the dot ) as they have lots of info on this kind of thing. VJ is more the happy path group ( relatively ) while they are they scaling the sheer face route.

This will not be over quickly. You will not enjoy this.

That makes much more sense.

The non appearance is a 5 year non waiverable ban.

This is really something to discuss with your immigration lawyer.

They actually mentioned the waiver at the interview, said even if I get the visa I would still have to do the waiver which would probably take months to get approved. Lawyers are too expensive, can't afford one. I'm focusing on his coming out here to marry me. Air fare too expensive as well. But I believe in God, and a little in miracles...

Well Immigrate2us.net is a good site for people with immigration issues. Hopefully you have enough income to fill out the affidavit of support.

Well, maybe the consulate you went through is/was very laid back and I'm pretty sure you filed some years back. Requirements now have changed a great deal and the rules keep changing (harder and more expensive). Who knows what the requirements would be in the next decade ...couples may have to make love in front of them to prove ....!

  • 04.14.2011 - K1-Visa Approved!!!!!!!!!!!!!!!!!!!
  • 04.21.2011 - Picked up Visa !!!!!!!!!!!!!!!!!!!
