I-134 - 125% poverty guidelines and taxes?

k1 visa, I-134 question:

my co-sponsor, has filed taxes for the past 10 years, and is presently and for the filing period of 2009 125% above the poverty level.

must the cosponsor be above 125 poverty level for the 2 years of tax returns that will be presented? we will be presenting tax returns for the years of 2008/2009....we do not believe he is above the poverty level for 2008....or atleast enough so for 2 people.

i only ask this because i believe the interview will be before 2010 filing of taxes.

as far as I know taxes dont have to meet the 125 povert guidelines, what really matters is how much ur making now .... his current INCOME!... so if his 2009 tax return meet the 125 you will be fine... if he didnt meet the 125 for two in his last taxes returns but he does in his current income he would have to back that up with paystubs, but I think you are fine
