I am a US citizen married to alien spouse who is currently here on the visitor visa. My wife never been married before but has a 13 years old son with here ex-boyfriend who is in her home country. Her son is under grandmother custody and he's not intend to immigrant to the U.S. Questions are

1. Do I have to disclose information about her son in form I-130 , form I 485 and form I-864.

2. Do I have to include her son's birth certificate with all the form above.

Thank you for any advices you may have.

1. No, Maybe if you want the son to come later. That's a whole different I-130 etc.

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Thank you for you response. I would hope then that the USCIS officer will not think that I lie about my personal informaiton of my wife. I was a little confuse with the question in the form when it asks such an information as list your spouse husband/wife including 'ALL' children.

I would list the son, since someday your wife might want to bring him here. We listed my wife's daughter, who is still in Thailand with her father since he has custody. We also included her birth certificate only because we already know she will be coming here someday. We did not want to complicate anything with USCIS and send up any red flags

when we petition for her down the road.
