Hi All,

We will be getting married September 25th on K1. Hope to have the license within a few day after and likely apply for EAD/AP/AOS either end of September or well October 1st:( I've heard that this date is when USCIS gets swamped with visa lottery people and the such...will this mean the process will be longer for us??

Thanks!

All applications are processed in the order they are received - the sooner you do it, the sooner it will be processed.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

I disagree with this. I applied for my AOS at the end of May, and still do not have my appointment letter for my biometrics while some other people who applied within a day or so already have their EAD. Their file may be entered into the system in order that it is recieved, but I think it depends on how busy the local office is when it comes to processing time.

Not unless someone 'MAGICALLY" forgot to enter you into the scheduling system...bio appt 3 months after i filed aos..i'm sorry but isn't it suposed to take 3 months for EAD on the uscis Website mhmm?

You cannot go by any timeline, there are too many variables involved. where you filed, if you were transfered, if your local office is busy. and uscis is useless at giving info, they just tell you to call back every 45 days....

I applied for AOS in August of last year, and had my GC in mid-November. It was just around 3 months from start to finish, with an interview. So, in my personal experience, there wasn't a fall slowdown that seemed to effect my application at all. But, every case is different and timelines seem to have slowed, so you never know I guess.

We sent the AOS package in end of Oct. last year, and I was approved for GC in Feb. (EAD, and AP in Jan.) That included an RFE which took about a month to collect the data, and send it back in. I feel I would have been approved much sooner otherwise.
