Fellow VJers,

Do you know of anyone who has cancelled a K-3 petition (I-129F) pending at the USCIS?

Given that IR-1/CR-1 petitions (I-130) are getting approved much faster, I'm wondering if I might be doing myself, and the USCIS, a favor by asking them to dump my 129F and just process the 130.

Any thoughts?

No need for that, the NVC will take care of it. They will only process you for a K3 visa only if they get the I-129F before the I-130 which rarely happens.

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

I haven't gotten to the NVC yet (I would like to, and quickly!) Both my 129F and 130 are still pending at the USCIS. My question is - in order to speed up the 130 processing at USCIS, whether canceling a submitted K-3 application would help (while both 129F and 130 are pending at the USCIS)

My 130 NOA1 date is March 31. Going by the IR-1/CR-1 time lines, they seem to be looking at petitions with end of March NOA1s. Would canceling the K-3 petition vault me into the IR-1/CR-1 queue?

I would leave it alone. USCIS is already incompetent. Knowing them if you try to close the I-129F, they might close them both. Just let them both take their course.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
