Hi Everyone,

I petition for my mother few months ago and she got approved and will be here in two weeks for the first time. Thanks to God! My mother will have her green card when she gets here...my mother have three childrens, one granddaughter and her husband in her country. I want my mother to petition for my oldest sister(33 yrs old) first in October. My mother does not have a job but i am willing to sponsor the whole visa process.I am US citizen.Can my mother file the I-130 for my sister and then I will sponsor her( my sister)? How long is it going to take when my mother files for my sister? My sister is not marry. Does her age matters? Another thing, I own IRS for 2009 tax year. I've scheduled to make payment arrangement with them.Will this affect the filing process? I mean, me being in debt with IRS. please help!!

Depends on many factors:

is your sister single? have children.

Only U.S Citizens have priority.

so your mother being a GC holder - your sister is not priority

that's all I know, because my friend is going thru the same process.

you have have to go to the dpt of state website, to see visa processing timelines for your country

Also go to USCIS.gov ->forms and look up eligibilty for form I-130 GC holder for unmarried son or daughter over 21.

C. Your unmarried son or daughter age 21 or older.

Looks like your mom can do it, but it will take very long time.

You need to check out the latest Department of State's Visa Bulletin. According to this your sister will fall under the Family Based 2B category (Unmarried Sons and Daughters of Permanent

Residents). Their chart shows that they are currently processing visa petitions that were filed in 01/01/04 for most countries, Mexico will be 06/15/92 and the Philippines has a date of 08/01/01.

Just as a side note, I have an aunt who's a permanent resident and filed for my cousin who's unmarried and 34 years-old. She filed back in 2000 and his petition was approved by the USCIS in 2008 but he's still sitting at the NVC waiting for a visa number. They're both from Colombia.

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
